Have completed 9 yrs at a tier 1 this year and they are not making me partner this year and presumable next also. How to deal with this and switch to a partnership role at a similar firm? Hardly any firm would laterally hire a PA as a partner. Anyone else been in this situation and how did you navigate it? Genuine real world advice/experience only.

Thx a lot for your response brother. I have a PQE of 3+ years working in commercial litigation, arbitration, civil litigations prominently besides various tribunals. Since past couple of months, I'm more of got into drafting only with some appearances and assistance to my senior in arbitration. I'm open to shifting to Delhi and nearby cities, but, the actual reason for shifting is that even my senior says that I'm quite good at everything.

Nevertheless, our clashes started because of atleast 12hr. working hours 7 days a week apart from the requirement to work some hours (which are not even considered) at home, unimaginable deadlines, even they make me draft arbitration awards for dumb ad-hoc arbitrators without even considering the gravity of work just to keep pressurizing with incomprehensive deadline.

I have two fold reasons that I want to shift:

1) I could have considered starting my own practice, but, even though I'm good at work, I have noo contacts. I have seen my senior that sometimes he fucks up the work of any client but they come to him because he portrayed himself to be personally attached with them, all these soft tactics to mislead, liaisoning and good network, owing to his past, has helped him to tragect and maintain his practice. My fear is that if I will leave this office, which I have to leave if I want to just live my life even as a human, I will loose my income and I have no contact as to how to grab my initial client. The initial clients also evade to pay a afresh advocate and I have any things to take care of with my money in my personal life at this age.

2) I am really interested in arbitration and commercial litigation, but, I have seen enough of arbitrations pertaining to building contracts, road laying, bridge construction, partnership, dealership, turnkey contract of electricity. I have no contact in any law firm, so I'm wondering as to how to get into a good law firm with varied arbitration and commercial litigation clientele along with financial security.

I'm at such brink of life that even a word from you guys is a great help for me. My senior is very good at sugar coating clients and he already had big contacts, due to his extrovert nature, in the city. I have seen many clients who readily give all their work to my senior even after not getting relief in some other matter. This industry is all about contact, and portraying personal relationship with clients. Yeah, providing relief also comes next. I have insecurity that if i will leave my senior, I will loose my income, I have no contacts, who will be my client and the constant struggle of grabbing clients, especially most of the initial clients would not have any high paying capacity, my senior made his relationship with senior officers of public department which majorly got his clientele. Oh and about sticking around, it has become very hard now, since all these years, I have done most of the challenging drafting of the chamber, and now mostly I do drafting. There is 12 hr. working 7 days a week, apart from that I could be constrained to work at home as well at times. Sometimes, sleeping for just 4 hrs. or no sleep for 24 hrs. a day. I receive directions to extend and expand unnecessary contents in a draft, literally unnecessary things, that too in short time and unthankful and manipulative senior. So, it has become hell to work here.

but how do you get in a circle full of smokers outside the office and not smoke when standing right there with them? I get what you say, since I do that in hostels myself where I socialise with people while just sitting around them while they're smoking. But it seems difficult in a job setting. What excuse would I even use to excuse myself?

TBH I don't really know. Maybe try alcohol? I don't smoke or drink, but somehow manage to rub along on the socialising/networking front just fine. But I must say I am quite surprised at what you're observing! I go to law school in England and have had experience of vac schemes at MC firms, and I have never seen this phenomenon! In England - the land of smoking par excellence!

Join them for smoke breaks, but don't smoke. Stand such that their smoke does not flow to your face. I did it for years - then took up smoking for altogether different reasons (and then quit, for good, for even different reasons). Point is, you can socialise with smokers without smoking.

I am in law school and I am in my last year. During this time I have noticed that most of the time the associate socialize w the interns during the smoke breaks and nothing else. Now I have heard from my friends and my seniors that it helps a lot, but I am someone who does not smoke and I’m feeling very scared that because I don’t smoke, I won’t be able to socialise and build a rapport with my associates, and I won’t be remembered. Is there a way around it? Will I have to start smoking to accompany them and talk to them informally? What do I do?

What would be the right career trajectory for me. I graduated from an NLU and litigated for 3 years. I don’t think it for me. I now want to make a switch.

What should I do

- Join an in house legal team (currently eyeing the Big 4’s)

- join a law firm (interested in PE/VC)

Receiving an Associate/internship application or realities of profession is not equivalent of comparing an argument regarding work-life balance. There is a fallacy in your whole argument it like comparing apple with oranges, while work-life balance/hallmark of a good organization purely depends upon how good an individual/organization in the following things including but not limited to Managing His/her employees/juniors, Managing workflow, addressing feedback for and by employee/junior, giving good work like arguing, drafting, negotiation etc (assuming if senior is getting one which mostly they get), not pushing false deadline ( except in the cases of urgent bail matters or urgent filing received in very very short span of time, etc. It is pertinent to note that a person might have the highest of legal acumen, knowledge, adept in court craft or managing client but does mean that person might be good in managing the organization or its employee/junior, as for the reason IQ and EQ are different. Most law firm partner and seniors lack EQ and managerial skills that why highest attrition rate in firms/ chamber which is sign of toxic work culture and inefficient management

Now, if we approach towards the receiving enormous internship/job applications that only indicates difference in supply and demand of legal work and jobs, which firm/ chambers are exploiting. Gone are times where people accede to toxic work culture, peanuts pay, no real work etc

Coming from different legal education systems and colleges of the country, I have realized that five-year LLB courses are quite long and must shrink to four years. This four-year course should be professional and in sync with the courts, subject-wise. I strongly believe in this way, both students and the legal industry will be benefitted. Considering the current scenario, if a student has five years of bachelor in law, then five years of practice, which makes ten long years. When will a student settle? Just like medical or engineering, undergraduate law courses must be shrunk to four years. Also, during this period, students should be directly attached with courts or lawyers, so that they attain practical knowledge.

I support such stuff! Make sure not to self victimise and instigate others to blame one person !
