LexOrbis win interim trademark injunction for FDCI against Global Lex Legal for Jabong

LexOrbis won an ex parte interim order in the Delhi high court for the Fashion Design Council of India (FDCI), restraining online retailer Jabong and Talenthouse Entertainment from using the mark “India Online Fashion Week” for Jabong’s online fashion shopping event held from 25July to 30 July.

Global Lex Legal is understood to now be advising Jabong’s parent Xerion Retail and its managing director Praveen Sinha.

LexOrbis partners Pooja Dodd and Abhai Pandey, and senior associate Swati Setia, having briefed senior advocate Rajiv Nayyar acted for FDCI.

Global Lex Legal advocate Vaibhav Dang have briefed senior advocate Anil Sapra for Xerion and Sinha.

The Indian fashion industry’s apex body FDCI promotes Indian fashion events globally under the trademark “India Fashion Week”, which is pending registration and has registered marks. In its suit for infringement, passing off, unfair competition and dilution against Jabong it alleged that the defendants are attempting to send out the false impression that their event is the online version of the India Fashion Week, and is either associated with or endorsed by the FDCI.

How is it ex-parte if the other side appeared before the court through their advocates?

Lame judgement. India Fashion Week itself is so generic that I would not want to grant a trademark on the words (stylized, insignia yes but not the plain text). India Online Fashion Week is not the same as Online India Fashion Week either.
