Phoenix Legal counsel Mukul Baveja has joined Shardul Amarchand Mangaldas as a salaried partner, according to his Linked-in profile as first reported by Bar & Bench.

Shardul Amarchand Mumbai managing partner said that he welcomed Baveja on board and that he would add to the firm’s “already strong team”.

Baveja was a counsel at Phoenix Legal, leading the contentious and non-contentious IP practice of the firm, according to his Linked-in profile.

He had joined Phoenix Mumbai in 2012 from FoxMandal Little in Delhi, having begun his career with a nearly three-year stint at Singh & Singh Associates in 2004 after graduating from Amity Law School. He holds an LLM in intellectual property (IP) from the University of London’s Queen Mary college.

He did not respond to a message seeking comment at the time of publication.

Phoenix Mumbai co-founding partner Sawant Singh commented: “The IP team will continue to advise clients with oversight from the partners who have the wherewithal to service IP work.

“I must add that Mukul will be missed. Great guy.”

What would become Shardul Amarchand Mangaldas’ Gurgaon office had lost its IP partner Ranjan Negi last year, with Negi joining Cyril Amarchand in May 2015 as a partner with principal associate Aarti Joshi, who was also boosted to partner level.

Shardul Amarchand’s IP practice is headed up by equity partner Dev Robinson.

Kian, you did that survey of the law schools that partners in different firms came from, some time back. With so much movement after The Split, maybe you should do it again!

Great move Mukul.. You are a great lawyer and a brilliant asset for any firm you are with.. As a friendly counsel assigning work to the firm, it seems to me that Phoenix is in trouble.. Kartikeya left last year immediately after graduating to salaried partner, Mukul leaves this year.. Both were Counsels at Phoenix Legal.. Personally knew both of them though could shared work with one of them regularly, given my organisations peculiar legal requirements.. I was aware that these Counsels were facing way too many problems with the management because of billing pressure and unreasonable expectations.. Extremely unfair for clients who have to continuously go forum [firm] shopping with the change in personalities.. Unfortunately Indian firms are not yet the "institutions" that their named/managing/co-founding partners make them to be.. The industry is still personality driven.. We went to Phoenix because of the guy we trusted.. As it is, the very name of the firm fails to draw confidence.. Phoenix, Rising from the Ashes!! Utter nonsense.. I personally was impressed enough to outsource to Phoenix because in addition to the personality approaching me, the partners were from another greater firm.. Do not quite know the exact reasons for such senior level attrition at this firm, but surely we need to introspect.. I for once am certainly going to hold known political patronage as a filter for assigning work.. Fed up with small firm egos and attrition!! Fight your own organisation first to assign work to an unknown firm and then lobby again once such senior level attrition's are brought to notice!! Rather stick to known and of course larger full service law firms!!

The Senior Partners (or so the like to call themselves) have a huge ego problem. Mukul deserved to be a partner. I have worked with Mukul not only is a wonderful person but also a brilliant lawyer. A big loss to Phoenix and huge gain for SAM. All the best Mukul. Time for Phoenix to re-look into its talent retention policy (assuming they have one).

Your argument has merit - Indian firms are personality driven.

However, you seem to also argue that "known and of course larger full service law firms" do not have partner departures! Partner and PA/Counsel departures are very common across all big firms and even entire teams break away. This happens all the time. Of course, if a big firm has long-standing senior partners who are unlikely to leave, and are willing to "oversee" (not work) your matters, its a different story.

Be a Roman in Rome and stick to the lawyer who actually knows your matters, history, requirements, and expectations. Change firms when your lawyer leaves.

No, that was not my argument. Its about assigning work to otherwise unknown firms when they are in the start-up phase.

IP Team?? Is Sawant serious?? From all we know, IP Team was just Mukul and this one lady who was his junior.. Best to you guys.. Blessed be your wherewithal to address IP issues..
