Exclusive: Khaitan & Co has not promoted any partners internally in its annual promotion round after internally restructuring its associate and partnership track, nine associates were promoted to senior associate level and one lateral associate partner joined in Mumbai.

“We don’t have any internal promotions this year [to partner],” Khaitan & Co Mumbai office co-founding partner Rabindra Jhunjhunwala said. “Ours is an equity structure, keep that in mind. We don’t introduce the salaried concept.”

Jhunjhunwala told Legally India that the associate partner designation, which was introduced in September 2010, despite being non-equity was not a salaried partner equivalent because the firm was “grooming” associate partners with a “clear-cut understanding” that they would become equity partners within two years.

Former Udwadia Udeshi associate partner Raj Panchmatia joined the Mumbai litigation practice yesterday, increasing the number of associate partners to three. Udwadia Udesh & Argus managing partner Krishnava Dutt was not available for comment.

Nine associates were also internally promoted to senior associate level at Khaitan with effect from 1 April.

It is understood that the majority of new senior associates graduated around 2007 and were alumni of NLIU Bhopal and NLU Jodhpur, with two having studied at GLC Mumbai, although the firm declined to disclose their names.

Career ladders

In 2011 the firm had promoted a number of senior associates to the new principal associate designation after creating a new associate career progression framework. Under the new system, associates are eligible to be considered for senior associate status after around five years of post qualification experience (PQE).

The promotion from senior to principal associate is possible after around six years of PQE or longer and is based on individual assessments, with a weightage of around 80 per cent given to performance.

For principal associates to progress to the associate partner level, they would have to demonstrate further potential and ability in areas such as business development after at least seven-and-a-half years of practice experience.

“I don’t think anybody within the firm would be upset that they didn’t make it because no associates were anywhere close to the equity level in terms of seniority,” said Jhunjhunwala about this year’s round.

Ganesh Prasad joined the firm as a partner in Bangalore yesterday after serving out his notice period at Amarchand & Mangaldas.

Outside odds: Better?

In April 2009 Khaitan & Co consisted of 32 partners nationally, with around 178 fee-earners in July 2009, according to data shared by Khaitan & Co with Legally India at the time.

In the last three years, Khaitan & Co’s partnership has grown by 23 partners to 55 – more than a 70 per cent increase.

Of those, according to Legally India reports since April 2009, 18 have been lateral hires, while 10 internal promotions not related to lateral hiring were reported in the same period.

Only one partner has been reported to have left to join other firms (see below).

Interesting story. This is one firm which has made many heads turn. I understand there is an all out war between AMSS and AZB at one hand and Khaitan on the other. Cyril in AMSS's HR roll out of 2011 said in front of all associates that one firm to watch out for is Khaitan. Hope they keep up the good work and integrate so many laterals. Enough of Cyril - Zia dominance in the market and their excessive personal PR play.

Growth in and of itself is meaningless - growth has to be profitable to make long-term sense. That may explain why Khaitan is slowing down on the partner growth front and will probably look to increase profitability before making further partners. In this context, it is also worth mentioning Trilegal. They seem to be growing quietly and steadily without much fuss.

Congratulations !!... looks like Khaitan is going to surpass both AZB and AMSS in terms of growth and money. Heard about the decent bonuses as well as recognising good homegrown talent by making performers as senior associates. While laterals have the advantage of throwing attitude and negotiating the SA-ship...a Fresher-Associate climbing the ladder of SA in 4-5 years really show his hard work and loyalty with the firm and its efforts. Considering this fact all the promoted SAs must have joined the fim around 2007-2008 - when KCO was just another firm and striving hard to get noticed. KCO should respect all its struggle time soldire. It is because of their support with some others that its partners and KCO could stand where it is today. Laterals come and go...

Prabjot Singh Bullar became an independent practitioner in 2011, it appears.

Ashok Dhingra has joined JSA in March 2009.

Bhumesh Verma joined PKA in 2009.

Naveen Goel left in 2006 to start up Naveen Goel Law Offices.

It does seem like Khaitan has unusually low partner attrition, however, when compared to other firms and despite their aggressive lateral hiring.

COZ other firms (like Kahitan and Co ) keep an eye on AMSS partners. They cant groom peole to that level. All said and done AMSS,AZB and JSA are class apart. Khaitan cant compete with them. KCO is very good in advt, others must take lessons from them. Every small thing is highlighted. Like taking a samll space on rent.

KCO has made the right moves. News on the street (and Kian you may be able to confirm) is that bonuses have indeed been very good. The Delhi corporate and competition practice has grown tremendously and people have been handsomely rewarded (especially the SA, PA etc. have been given very nice bonuses). Bombay remains very strong and they are backing Bangalore to the hilt. As an industry guy I note that they seem to have weeded out the non-performers, while performers have been rewarded. Way to go... KCO partnership will soon become very lucrative indeed, especially in corporate and competition!

While Delhi might have weeded some non performers, it has also lost some performers.Granting good bonuses might keep people on board for sometime, but not forever! Challenge lies in creating a good work environment within the firm and doing some introspection!

Let me just say that Khaitan this year has given bonuses to some bull licking senior associates (corporate team) who are nincompoops. From what I have heard from credible sources, at the associate level (corporate team), things arent as rosy as it seems in kco, with a lot of favoritism and incompetency ruling the roost. amss and azb can just chill, kco is nowhere near them.
