KPMG-bestie Advaita suffers another body blow as HSA raids Delhi dry with Singh-Shankar-Dutta trio

HSA Advocates has hired Advaita Legal partner Shailendra Kumar Singh, counsel Alok Shankar and principal Monali Dutta as partners in HSA’s Delhi office with their teams of another seven fee-earners.

Shailendra Singh (a lawyers since graduating from Delhi University in 2002) had been heading projects and infrastructure at Advaita, having previously also worked at Luthra & Luthra and Trilegal. He was promoted to partner at Advaita in 2018. He specialises in infrastructure, energy and resources.

Shankar is a 2007 NLIU Bhopal graduate, who does regulatory and projects work; Dutta is a qualified lawyer from Delhi Unviersity and company secretary, and started practising in 2008 (including a four year stint at HSA from 2011 and 2015), and she specialises in infrastructure, aerospace & defence, IT & ITES, healthcare and project development.

Founding partner Hemant Sahai said in a press release: “They add further strength and caliber to our existing service offerings and will help in supplementing our capabilities in the respective practice areas. I am especially delighted to have Monali back with HSA and am looking forward to working with her again.”

Advaita: What’s left?

We understand that the raid by HSA leaves Advaita’s Delhi office substantially without any partner or senior or even fee-earner presence, though Mumbai might still have a few fee-earners remaining.

Somehow Advaita therefore still seems to be continuing, but it is unclear what the ownership structure would be without any apparent remaining partners, to the best of our knowledge. According to LinkedIn, there are around 10 fee-earners left at Advaita, with one principal, Mihir Deshmukh in Mumbai, and no partners.

KPMG has, at least externally, been notably hands-off in the day-to-day operations of Advaita but its fair to say that even with the Big 4’s support the brand is on life support.

Partners got retainer for January two weeks ago. Associates just got paid for March.

It’s funny how under the guise of pandemic, people can have the audacity to do this.

Revised many times (even downwards). They’ve reduced retainers for all partners, paid half bonus for FY 19-20 as late of February this year.

Kian, it’s hardly a raid. These guys had been looking out ever since KPMG asked Advaita to shut shop.

A retained partner at HSA could very well command a fixed monthly retainer upwards of 7L.

A retained partner at a place like HSA would start at anywhere between 3 to 3.5L. If the practice area is lucrative and the equity partner leading the practice is generous, then you are looking at a retained partner making around 4L. Partners at Tier 1 firms do not make L7 and upwards unless they have been retained partners for over 4 to 5 years and have opted not to get equity.

Broadly, partners are supposed to get anything between 2.5-8.5 lakhs monthly. When they get it is another matter

HSA cannot pay retained associates their due, wonder if they have bucks to pay partners. In the garb of covid no one is paid. Most corporate firms have done very well and have paid associates. Hsa has only used it as an excuse to not pay and give bonuses or increments

HSA is everything that is wrong with the law firm culture. We need to approach the court to enforce contracts because all firms like HSA do is exploit people. Nobody should quit without getting all the money they are due. That's what the firm wants. Fight it together. HSA has the money to pay their resources and not paying on time because of COVID is a lame excuse and nobody should buy it. If the work isn't stopping, the salaries should be paid on time. Add to that the incompetence of the management in addressing the salary situation, yes they don't even acknowledge it, let alone paying on time, it's amazing how people are getting hired and actually joining without doing any basic due diligence.

I've heard that people who left HSA in 2020 (after April) did not receive their bonus for 2018-2019 and 2019-2020. Logic being they were not in the system when bonuses were paid in February of 2021. Some strategy these guys have of delaying bonus and retainers and when people leave not pay bonus.

It's unfathomable how they are getting new people without paying the existing lot. It's an open secret that every HSA lawyer and support staff CVs are in the market.

Salaries paid till January for partners and March for Associates. 'Bonus was paid for 18-19 and 19-20 in February. CSO is getting a lot for zero value addition. No wonder he was shown the door at KCO and ELP
