PDS Legal partner Tarun Gulati, who had joined in 2013 from Economic Laws Practice (ELP), has been designated senior counsel by the Allahabad high court, as part of a mammoth round of 75 new senior advocates.

He commented: “I am truly humbled by the honour bestowed on me. Allahabad High Court is my parent court and I am grateful for the recognition that it has conferred on me and I will try my best to uphold the high traditions of the Court.

“I owe this to my colleagues, both senior and junior who have stood by me through thick and thin and the clients who showed faith in me all these years.”

He is a 1990 Allahabad University graduate, who had worked at the chambers of senior counsel Joseph Vellapally before moving to ELP.

He had been promoted to equity partner at ELP in 2013.

He had moved to PDS with a team of around 11 associates.

He will have to resign from PDS’ partnership due to restrictions on senior counsel being part of law firms.

Designating 75 advocates as Senior in one go, is a joke. The High Court has done the biggest dis service to the profession. The institution of Senior Advocate has been diluted. Very sorry state of affairs.

Wouldn’t this also work to their detriment? They can’t legally operate filing practices after being designated. So, as I see it, these group of individuals must’ve been dead sure that they will remain constructively employed, that they’ll get arguing briefs from junior counsels. Isn’t that enough?

Filing will still be done by them, but the vakalatnama would be that of their juniors. Everything else will be handled by these seniors.

Fair enough. These opportunities would present such juniors to shine somewhat, and edge out their seniors ! Isn’t that the case, more often than not?

Not really. As Guest said, everything including drafting, appearances and client meetings are handled by the senior advocates. Very very difficult for juniors to edge out seniors (unless they become somebody else's juniors). After designation the senior advocates can charge higher fees. Other than that nothing changes.

Allahabad High court is the largest high court in the country and has only 65 senior advocates for more than 18000 advocates in allahabad only and another 10000 at Lucknow. Surely, they need more than 75!

Designation of seniors is not based on the population of advocates practicing at the High Court. Please refer the Advocates Act, it lays down the factors that needs to be weighed before designating. Even in India Jaising's judgment, SC has not made the population of a court, a factor for designation. The considerations are different, to say the least, merit is and must be the most basic one.

Scam. Tarun's principal place of practice is Delhi and yet he chooses the Allahabad High Court for his designation. He has less than 15 reportable judgments from Allahabad. If this is how designations have to work then MP Devanath is eligible for designation from Rajasthan, MP or Chattisgarh. This is how you game the system to your advantage since your forefathers have been judges in Allahabad. His designation is in teeth of the guidelines laid down in Indira Jaising's case decided last year.

His brother, Kavin falls within the same elite group. His principal practice though is in Delhi.

..no scam...no kala......! he comes from a family of senior counsels and HC, SC judges for last 3-4 generations and hence he is entitled to all these positions and designations from any court more than anyone else on this earth !

Can't agree more. Practicing in Delhi for half your life and then going to Prayagraj to take the senior gown on the basis of a few appearances shows desperation and how the designation process is still subject to abuse by a few individuals. Shameful.

Don't know what to say. Gulati's designation from Allahabad is questionable as he has not practiced in Allahabad. Hope the Chowkidars sitting in Supreme Court are watching this.

Don't know if all the other advocates deserved the Senior designation, but Tarun Gulati definitely deserves it. Hes a brilliant advocate with great work ethic.
