Private vax overdrives: How law firms struggle getting corporate jabs (and why most might prefer doing it quietly after #SAMCares)

Over the past days, legal whisper networks as well as social media sites have been abuzz about Shardul Amarchand Mangaldas’ (SAM) vaccination camp, which had begun vaccinating all of its Delhi staff at its Okhla offices.

The reason there was a buzz: Instagram and LinkedIn posts of SAMmers in a “MAX @Home-branded ‘selfie’ photobooth with a SAM banner in the background.

The firm had tied up in Delhi with MAX for a camp, which the chain of hospitals had branded with the tagline of “Welcome to the World’s Largest Vaccination Drive”.

An internal SAM email, sent two days ago (12 May) to all staff with instructions about the Delhi vaccination camp, suggested to “click your selfie against the SAM standee” and tagging the firm with hashtags including #SAMCares #SAMrocks #igotmyshot #workplacevaccinationdrive #organisationsthatcare.

Several heeded the call on 12 and 13 May and posted on Instagram and LinkedIn with the hashtags (though there were no more posts today, on 14 May).

Screenshots from the mail soon began making the rounds on various messaging services, raising a few eyebrows both within the firm and sniping from the wider profession, with one commenter in the Legally India conversations section invoking it as a sign of “late-stage capitalism”, an internet meme that has been gaining some currency online.

A SAM partner involved in the programme declined to comment when contacted, and other law firms spoken to requested anonymity.

However, SAM is far from the only law firm (or corporate) working on vaccinating its staffers, albeit with varying results (more on that below).

More than just optics

“We have Delhi happening next week but we don’t want to put [anything] in the media and have told people not to do social networking posts,” said one lawyer at a big Indian firms, when asked about their plans.

“[A large conglomerate in Mumbai] provided vaccines for all employees across its companies […] and five family members,” they said, adding, pointedly: “Without hash tags, sound dance and light show.”

It is not at all surprising that law firms should want to vaccinate their ‘people’: getting your shot, especially for most under-45s, is at this time basically a lottery for slots on the official CoWin website, like a more serious version of trying for cheap Tatkal train tickets on IRCTC.

And besides potentially saving the lives of your colleagues and their families, there is also another (usually unspoken of) benefit: for corporate law firms that can get fully vaxxed-up, life might just return to ‘normal’ a little earlier (notwithstanding the huge question marks of whether second shots will even be available for anyone any time soon).

A similar rationale might also be imputed into the government’s part-privatisation of the vaccine drive, which could get corporates and the most affluent back to ‘normal’ the fastest and help GDP figures look better, while also appeasing certain powerful vote banks.

### Not just about the law (firms)

The (mostly whispered) outrage that SAM has faced about its vaccine-related social media campaign is therefore a more nuanced affair, which is bigger than a single law firm: after all, SAM had only been following the law and current regulations.

Sure, publicising vaccines in the strange days of anti-vax and Covid-denying conspiracy theories has value. But it also has potentially terrible optics when elite lawyers and comparatively privileged BigLaw staff post selfies about getting their jabs, when (mostly) poor people are dying so fast in many states that crematoriums can’t keep up with dead bodies and worse.

But fundamentally, the opprobrium is perhaps also related to the vaccine policies themselves, which part-privatised vaccine distribution for those younger than 45.

Murali Neelakantan, the former general counsel of Cipla and Glenmark, had today co-authored an opinion piece pointing out the many inefficiencies and fundamental policy problems in the vaccine roll-out strategy, as one without global precedent.

With the pandemic, both in its 1.0 and 2.0 incarnations having already disproportionately affected the poor, as activist Harsh Mander today elucidated, citing new research, an obvious question is why the lives of those working in corporates and law firms effectively get priority?

Struggles also for corporate lawyers

That is not to say that every corporate lawyer is going to even see their first dose of the jab anytime soon either.

On paper, corporates can get priority access to vaccines for their staff. The reality is that demand still far outstrips supply and is likely to do so for a while yet.

Senior law firm partners and managers who were working on rolling out vaccines programmes for staff were mostly unkind. “What a mess,” said one; another used the word “chaotic”.

“None of them [private hospitals] are permitting anything at the moment, firstly not all of them have stocks available, and wherever they have stocks, they have committed to very large organisations,” said one person at a large mid-size law firm familiar with the process.

Two senior law firm sources involved in the plans said that the hospitals they had contacted had told them they were prioritising holding “vaccination camps” for larger organisations, requiring minimum numbers of at least 400 to 500 staff who can turn up to the office camps.

Number games

Having minimum size requirements for Covid camps makes sense for two reasons.

First, the logistics required for organising a camp are not negligible.

On the government side, a “district task force chaired by the district magistrate and an urban task force chaired by the municipal commissioner will administer the process. Senior staff at the workplace will be selected as the nodal officer to coordinate with the respective authorities,” according to to a report in DNA about the regulations.

On top of that, according to several persons familiar with the process, the hospital would need to effectively set up mini-mobile hospitals in an office, requiring several different rooms (waiting, shooting and post-shot monitoring), as well as trained medical and admin staff to run the show and an ambulance on standby outside the office.

In case “anyone should have an adverse reaction, our office spaces are not equipped”, said a partner, while another partner criticised such in-office camps, which “in these times takes away medical staff” from hospitals.

The second reason might simply be about profitability: the Times of India reported recently that four private hospitals charged from Rs 700 to Rs 1,500 for shots for individuals.

However, a person closely involved in a law firm’s efforts to procure office vaccines said that for an in-office Covid camp, hospitals were quoting around Rs 300 to Rs 400 above the standard (private) cost of the vaccine, while a person at another law firm said they had been told it would cost Rs 1,800 per shot.

The person added that a hospital said they could only vaccinate 150 to 200 staff per day at most at each location, to maintain safety precautions (more could presumably be done at much larger office spaces).

To be sure, the rates and numbers are not exorbitant but it might explain why hospitals are prioritising larger organisations where there is a bigger profit to be made.

While one hospital told Forbes that “we may have specific preferences for some of the corporate customers and could try and plan on that basis”, there is also no real transparency on how hospitals are prioritising between selling shots to mega corporates for larger margins versus those sold to the few private citizens.

It stands to reason that profits will be at least one of the determining factors in how shots will be allocated out of the approximately 25% of manufacturers’ vaccine capacity reserved for the private sector (the other 25% might go to states and 50% to the centre for over-45s).

Off-site vax priority

Even for on-site vaccination drives, individuals are still required to register on the government’s CoWin portal so their vaccination can eventually be linked to their identity.

Registering on the site has not been a problem for most (at least those Indians who are somewhat technology savvy and with the right access), but the difficulty has come in booking an appointment when small batches of vaccines are near-randomly released and usually snapped up in minutes (even the system that had encouraged third party apps to query available slots has been significantly curtailed around a week ago).

As such, some law firms are trying to go for the second option where a hospital will set aside time for corporate staff. Under this corporates-only programme, staff would automatically get slots booked for jabs on the hospital premises (as long as they are already also in the CoWin system).

Quiet influence

Even getting into an on-hospital corporate programme is not guaranteed: in these early days, getting a corporate Covid programme organised at a law firm is ultimately also about soft power.

Perhaps in light of the sensitivities and optics, no private hospitals we could find have strongly publicised or advertised their corporate vaccination camps, let alone details on how to register or whom to contact.

“It depends about which hospital, what your relationship is, etc” about whether you can get them to come to you or tie-up with you, said one lawyer.

A law firm manager added that in Delhi “we are talking to them [hospitals] but they are not showing interest, we are even pushing through senior level [partners at the firm with relationships with the hospital chains]“.

As such, perhaps also showcasing it as one of the best-connected law firms in the national capital, SAM was the first law firm out of the blocks with its Delhi camp, to the best of our knowledge.

Another firm’s Mumbai partner said that in Mumbai no such hospital tie-ups were available for law firms yet; one in Bengaluru said it might be possible to make deals there; a Noida-based law firm partner based said that being located in Uttar Pradesh added to the complexity.

“It’s all very fluid. We have been very keen and were probably the first to plan as close to May 1 but UP hadn’t framed guidelines at than time and then the government took back the unused vaccines from all the earlier facilities by May 1 and then everything [went] very topsy turvy.”

The topsy turvy part looks unlikely to change.

But it is likely that future law firm vaccination camps, if any, will go down rather more quietly.

Good that workplaces are taking this forward.... Helps diversify/ decentralise vaccination points and reduces the spreading of covid when people step out . People please be careful of closed hospital waiting rooms/ observation spots without ventilation after your vaccination.... More the number vaccination access points the better for us all (whenever the vaccines and boosters are available though!)... Also perhaps good to publicize and promote use of infrastructure for vaccination drives. Everybody must try to offer logistical support where feasible ... it is a terrible time and let's unite to fight together, especially using your privilege and resources to donate to the right organisations making a difference

SAM just showed the true meaning of 'cringeworthy'.

I am from a tier 1 firm and got vaccinated in the official drive without any pomp and fan fare (like it should be). In fact, we were told to be sensitive and respectful to all that is going around in the country and not click pictures.

I have no words how shallow these Lala firms are. My resolve for never working in these is stronger than ever. Hope sense prevails and these Lala shops soon become relics of the past.

Like the previous commenter pointed out, why has one law firm managing to get vaccines for its lawyers managed to rile up LI and the others commenting in the article?

Are we going to pretend that most of us wouldn’t grab an opportunity to get vaccinated today if we could? The cowin system is essentially a lottery at this stage, and SAM, acted within permitted guidelines to set up a vaccination drive for its teams.

This is the time to be holding the government accountable on why getting a vaccine is a game of roulette, instead of wasting time on such articles.

SAM’s move was the most tone deaf & embarrassing thing I’ve seen in a law firm & the sector specialises in those. I would still like to thank SAM sincerely. Explanation: I work in one of the Tier 1s in Delhi & abt to be vaccinated next week. A friend of mine works in an almost Tier 1 in Bangalore & she’s vaccinated already. Neither of the firms have said a word abt publicity. In fact they’ve aggressively discouraged it. This couldn’t have been possible without SAM. Thank you very much for forcing the rest of your competitors to be decent.

Working at a top institution has its perks. By definition, lawyers working at one of the best firms in the country are bound to benefit from their being retained by such firm, and there is absolutely nothing wrong with that. Instead of taking this platform to try and bring down an entity that has tried hard to protect and care for its own, why don't you try and encourage more organisations to try and do this?

SAM did this first and everyone else was caught napping and now the others are doing a Modi. To shield themselves from the ire of their associates they are calling it a publicity stunt. It’s a case of sour grapes.
I’m glad a few of the 100s of people who got vaccinated at SAM shared stuff on social media, why:
1. It has forced other law firms to try and get their people vaccinated;
2. It encourages people who would be hesitate to get vaccinated to get the jab. If the top lawyers in the country are getting it, then we should too!
Oh, and yes, SAM does care. Their Crisis Response Team has done phenomenal work, not just for their lawyers but their lawyers families, alumni and clients. From finding hospital beds, to oxygen, to medicines, to mental health experts.
It’s a shame that Legally India is going the way of a trashy tabloid as opposed to a good website on law firms, the law etc.
For those who claim their law firms vaccinated their lawyers prior to SAM, please name your firm - you cannot, Coz it didn’t happen.

You clearly don’t know how all of this works. The efforts started way earlier. Other law firms didn’t start the attempt just because SAM did it. The very fact that other law firms have managed to already get some of their people vaccinated without the hashtags means nobody was napping and SAM certainly didn’t wake them up. As a student from one of the top 3 NLUs and who has friends across all 5 top NLUs, I’d say that SAM seems more like 5th or 6th choice rn. People are not interested in going to SAM especially because it is really not known for its work culture especially in universities. I mean none of the tier 1 have good work-life balance but SAM is like really ewwww from what we know. Please improve the way you work or we might stop inviting you for day 0 and ELP would be considered a better firm

Dear SAM bhakts,

You got your vaccine shot - good for you. In the larger interest of the country and for yourself, we are absolutely thrilled that you got vaccinated!

As for the rest of us common folk (read millions of Indians), we are trying, on a daily basis, to get a slot through Cowin for us and our dear ones and have this far lost to this "lottery system". We will keep trying though (not that it should be of any concern to you).

Our only point is that, given that millions of fellow Indians are doing all they can to get vaccinated and still failing to get one, you parading your privilege (only by virtue of working at SAM) on FB, LinkedIn and Instagram (whether mandated by your firm or not) is in poor taste and is an insult to the rest of us who do not have your firm's clout and connections! Add to that your lame attempt at defending your thoughtless actions on this comment section is only making things worse! A better strategy would be to simply accept that you messed up and we can all move on! There is only that much we can do to instill some humility in you, since we have to go back to refreshing the Cowin website. Request you to please oblige.

One may criticise here but factually, SAM has managed to be more popular, get more followers and students die to get a job there. They are master planners. They don't care about your article or comments section.

What SAM and anyone 'celebrating' vaccination drives need to understand is that the entire exercise of vaccination is being undertaken in extremely sombre circumstances, especially taking into account the second wave and its devastating impact on India. As someone who has been directly impacted by Covid and who has friends (some in law firms) who have lost parents and close relatives, the act of getting vaccinated is not anything to be cheered for or celebrated. If anything, it is a reflection of the extremely harrowing times we find ourselves in. You may have been lucky to avoid the virus or privileged enough to get beds/Oxygen/medication but for someone (and this includes some people in Tier 1s) who has lost a father, mother or relative, vaccination is nothing but a hollow reassurance bordering on guilt.

Apart from being as tone deaf as possible, I find such PR exercises (such as the one by SAM) not too dissimilar from the Covid frauds going around. This is just a glorified version of the same but is essentially on the same principle - taking advantage of a dire and desperate situation. I half expect people to now come out fighting stating they were only trying to spread 'positivity'.

I suppose we cannot expect too much from firms where the general prevalence is that they have bought their employees in essence. It is just how they view the world and that is the sad reality of it. Hopefully people will gradually take note and keep moving/leaving these firms.

Organizing a vaccination camp for the staff is a great initiative, however, not having any confidence on your own staff that they are going to appreciate it, hence, making it mandatory for the staff to appreciate the camp speaks volumes about SAM and its trust on its employees.

Further, showing some sensitivity amid the crisis in the country where most people are unable to get vaccinated can be expected from such a big firm. If at all PR was needed, they probably could have an article or a statement published (if at all) instead of insensitively asking their hundreds of employees to click pictures and upload them when fellow country men are fighting the pandemic and dying before getting vaccinated. Again speaks volumes about SAM and the real intention and spirit behind its corporate social responsibility. Atleast shouldn't have made it so obvious!!

Last and not the least, many people have mentioned lala firms so let me put it this way that SAM is the biggest 'lala firm' in the country where one 'lalaji and family' are running the business and how so ever talented the employees be, they are never going to make it to the top notch ladder. So people quit this mentality of sucking up to slavery and encouraging it. I have worked in top tier-1 firms and of all, SAM is one the least democratic set up s where people live and work for the one lalaji family and will never even be able to sit next to them! Where apart from our or two teams, most of the lawyers are doing repetitive work and lawyers in mid law firms have far more exposure of work than these. You can never be a boss in SAM but only a highly paid slave.

None of the international firms did this and waited their turn in the general public. Not that Indian law firms are to blame but more a function of how the vaccination roll out in India is a mess in the second stage.

Appalled to see how commercial and insensitive SAM is even during one of the toughest and testing times for the country. They can produce good lawyers (not all as I have seen the quality, a lot of them are sons and daughters of big shots and retired govt officials with zero legal aptitude) but horrible citizens who have to obey to the command of lalaji and family (saw the term in the thread of the conversation). SAM CARES ONLY ABOUT NUMBERS, NOT MORALS.

I wonder how Sammers felt when they were instructed to show off being vaccinated amid the sufferings of their fellow brothers? Would we do the same if one of our own family members had succumbed to the situation or about to. Well! I guess they didn't have much of a choice- atleast those who are sensitive and won't have done this if they were given a choice. Tier-1 firm SAM is not only encouraging the slavery corp culture, nepotism but also forcing its employees to do horrible things with low morals.

Inheritance, nepotism the biggest side of SAM. Always promoting their own be it under any legal award category or what ever [...]. Any awards, recognitions you name it and you will see the two plus 1 nepo lawyers winning and don't we know how this happens. Therefore when any Sam employee is proud of working at Sam, they should be proud of serving at Sam, not working. In view thereof they don't have much of a culture but fake culture. They are like any other commercial entity promoting their own from generation to generation and playing the number game. Be mentally prepared to be a highly paid slave with less self respect if you are willing to serve there.

Frankly,both CAM and SAM have bad cultures but I think SAM is a tad better than CAM in terms of work output of better quality.But what really does become unbearable is CAM just reeks of arrogance at all levels,even their associates carry this entitled attitude.Until the market rejections begin to hit them

Both have been lucky generation after generation. There are many more firms doing a good work with first generation lawyers who started much later, after the corporate legal market was already established & monopolized by the few families. For SAM CAM AZB etc, it was a first mover advantage with connections and books served to them on platter. Benefits of being born in a renowned family at the right time. Good for them but just expect them to show some humility and actually treat their staff with respect.

Sam could buy Jor Bagh Bungalow for over 100 crores but not donate a few at the time when country needed it the most. So selfish. Just keep buying awards for the next generation but no morals. Highly disappointed with big firms not making much if a difference but only engaged in money making. Indian companies are better than Indian Law firms.
