Trilegal’s partnership has completed the vote to induct Shardul Amarchand Mangaldas (SAM) Mumbai-based litigation partner, Nitesh Jain, as an equity partner.

The 2007 SLS Pune graduate, with an LLM from the London School of Economics (LSE), he had been a partner at SAM since 2016, having worked at precursor firm Amarchand Mangaldas since 2009 (with a one-year stint in 2014 opening his own chambers, and half a year as a consultant with Cyril Amarchand Mangaldas before returning to SAM in 2015).

We have reached out to him, Trilegal and SAM for comment.

Delhi-based partner Shankh Sengupta is Trilegal’s head of the disputes practice area.

Sengupta had taken over the role from Sitesh Mukherjee, who had left around April 2020 to become an independent counsel.

Mukherjee had moved from Delhi to Mumbai in 2017 to build up Trilegal’s disputes footprint in the city; that remit has probably been inherited now by Jain.

Update 17:04: According to Trilegal’s press release, he specialises in “corporate commercial disputes, international and domestic commercial arbitrations, white-collar crimes and advises and practices across diverse dispute resolution forums”.

He will be Trilegal‘s partner number 56.

Sengupta commented in the press release: “Nitesh is among the top-rated disputes lawyers in the country and is a great addition to the firm’s disputes practice.”

Huge loss to SAM. Nitesh was handling the TATA Cyrus matter. He was recently named Disputes Star of the year. How long is his notice period. Heard his team moving too. Shroffs won’t be happy. None of the we wish him all the best drivel.

Sad to see him go. Impatient IMHO. You need to learn to run before you can fly.... 1 or 5 large matters doesnt make you a star..... opprtunistic and illadvised move but definitely a loss for SAM.

Trilegal carefully identifies Partners at CAM/ SAM / AZB who are okayish and not offered equity partnership by their own respective firms and lure such Partners into the firm (read: Trilegal) by offering more money and equity. Would be quite interesting to see if Nitesh is able to do any justice to his new position at SAM considering he will have to start from scratch and do hardcore BD.

Imagine that Mumbai Trilegal disputes was being run from Delhi by Sitesh.
It's mostly regulatory tribunals stuff and itsy-bitsy matters. Nitesh will have to develop a Mumbai based top flight litigation practice from scratch. Whether he can in a crowded Mumbai litigation market is anyone's guess. That said, he was overshadowed in SAM for sure. In litigation, either you are a star partner or you are a nobody.

In SAM Mumbai, there's Rishab and Ameya. Rishab is an equity partner and probably the best arbitration lawyer in the country. Ameya is an excellent general litigator with a large IBC practice.

Amongst such stellar lawyers how does one litigator work? Best arb lawyer in country ?? He only does int arb and then poor guy is stuck for enforcing any awards if he gets.

Completely depends on his ability to get new clients and matters. From what I have heard, he barely had his own clients at SAM and all matters were referrals from other Partners at SAM.
