Bar exam: Hall passes to be downloadable as study mat non-recipients grow

Hall admission passes for the 6 March all India bar exam will also be available for download over the internet, announced the Bar Council of India (BCI), also revising upwards from 37 to 143 the number of applicants who had not received any study materials in the post.

“Preparatory materials have already been dispatched to each of [22,282] candidates and admit cards for the AIBE have also been dispatched to each candidate,” said the BCI in a statement dated yesterday (21 February).

However, the BCI added that an online facility would also be made available to receive hall passes: “Candidates who do not receive their admit card, for whatever reason, can download the same from the BCI website from February 24, 2011 onwards by typing out their assigned roll no. for the AIBE, print out the same on normal A4 size paper and carry it.”

On Friday Gopal Subramanium had told a legal news website that admit passes would also be available at the examination venues but this was not mentioned in the official announcement, which was signed by Subramanium.

The BCI also posted a revised list of candidates whose preparation materials had been returned for a variety of reasons. has been put on the BCI website and candidates are requested to get in touch with us urgently and arrange to collect the same. Meanwhile, preparatory materials are available on the BCI website.”

The updated list of those not having received materials has climbed to 143 names, more than the BCI’s list of 3 February with only 37 names. Legally India reported on 14 February that the figure of 37 was questioned as being too low by a bar exam challenger in the Bombay High Court.

Other information:

> Candidates will be required to carry a proof of identity (original of passport, driving license, PAN card, Voters ID, ration card or State Bar Council Enrolment ID , and show the same at the examination centre for entry to the AIBE.

> Candidates will be allowed to carry any books/ reference materials (including the Preparatory Materials for the AIBE. Candidates will not be allowed to share these materials.

> Further, mobile phones, pagers, laptops or any other kind of electronic devices will not be allowed into the examination hall. Candidates will have to make their own arrangements for storage of these items outside the Examination Hall.

> The BCI also requests any candidates who have special needs (on account of any physical disabilities) and require scribes for the AIBE to contact the BCI (through email or over the AIBE helpline) immediately.

> The AIBE timings shall be from 11:30 am to 3 pm. Candidates must ensure that they reach the examination centre in advance – entry to the examination centre will not be allowed after 11:15 am.

Dear friends read carefully.
What is the meaning of open book exam? Again why these instructions?
"Candidates will have to make their own arrangements for storage of these items outside the Examination Hall".
Why should we store the books outside the examination hall. Is that the meaning of the open book exam.

Candidates will be allowed to carry any books/ reference materials (including the Preparatory Materials for the AIBE. Candidates will not be allowed to share these materials. That means candidates can carry their material into the examination hall. Since one year you already confused us a lot, now don't confuse. We all will carry our books into the examination hall that is our responsibility to look after our books.

Friends, Gopal Subramaniam, Bar Council & Rainmaker (the partners in so called All India Bar Exam) have already caused immense harassment to young lawyers community all over India.

Lawyers who have already passed over 50/30 papers of LL.B. 5 years/3 years courses of different Universities/NLUs are being forced to write an 'Open Book'/Multiple Choice Paper to get eligibility to practise law which they already possess after passing LL.B. degree.

Should not this exam be boycotted by one & all and Gopal Subramaniam be ghraoed in Supreme Court or BCI office till he passes an order to cancel this useless exam??

I live in Tripura and for me there is one exam center only .Gauhati.in Assam there are seven states in North East but exam center is only in Gauhati ..this is ridiculous.It is quite a task to travel to such a distance .BCI u listening

You should be a sport rather than getting irritated. FYI I am giving the exam and I very much support it! It is very much needed to maintain the quality of our profession. Passing an exam (at university) is not a big thing, we all know that. What is important is to test your analytical ability. You will say now that AIBE wont test analytical ability, it will indeed be a beginning for such a test. So rather than wasting your time here, good luck my friend for the exam!

plz brother go to court and then u will understand what is required to be a good lawyer... analytical brain is a matter of practice not 3 hrs test..... a profession cant be for those who has above average analytical brain but also for those who has average or below average capabilities.... Those who r average and below that they can gain that height only by practicing and polishing themselves ... So Mr. 21 dont be so selfish not to care to look at your brother who might not be intelligent to ur par....
More ..a 100 marks exam can never judge the analytical ability of a advocate..mind my word 'advocate' not a laymen or any other professional men...

i selected to study law and completed my graduation in one-go solely because it was MY decision to study. now when i open the aibe book to study..........i just don't like it because this was not in my agenda. how can BCI compel and force upon you some crap rules which they thought of overnight? studies is not something that you force upon someone. it should be the students decision. if we knew of this exam maybe we never would have pursued the law-course. my 5 years / 3 years efforts in graduating in the law field cannot take away my practice rights which the Advocacy Act has given me. do u agree?

No.13 and 22 you both are looking for 100 multiple choice questions and answers only, you both need practical experience. Better have patience while dealing with clients. I know how to deal clients. Don't try to teach others it seems you don't know others capabilities. How much time wasted by BCI almost one year is spoiled. Whoever you are it is your moral responsibility to support your collegue. Why Tejpal approached SC do you know? If you know you don't make meaningless comments.

Who is RM to conduct exam what Right RM is having ?
You should know there are many universities and many intellectuals, professors in India to conduct this type of exams if BCI approach them.
This is not the place to comment on each other. This is the place to share our ideas and solve the problem. Instead of doing that commenting on others is not good. Hope you understand.

suggestions Possible Activities in democratic way (Ghandiwadi way)

1. Go for hunger strike
2 . Let that body of advocates go and meet GS AND Law Minister while other will be in the hunger strike
3. Approach Rahul Ghandhi
4. Boycott the exam but if few advocates gv it it will spoil the entire move.
5. Dharna infront of the BCI office , Delhi

OMR SYSTEM

There r many problems with OMR system....from my experience i am telling..i am the counsel in one such case where exam was taken by OMR system but the correction was faulty. Understand the omr system .in this system some1 will enter the answers in the computer and then depending on it the the computer will gv the results.... Now due to human error if the data is wrongly put which was done in my case then the results will also be wrong..inspite of the fact that u gave the correct answer... Brothers see this is a question of our livelihood and career and in such a irresponsible way they r conduction it ....its like robbing us of ur livelihood ..

There can't be 9 lac law grads every year. If there are 600 colleges that would make every college have a batch strength of 1500, which is a tad high.

I think the official guesstimate by the BCI is around 60,000 grads this year. I think they did some fairly thorough research asking every college for batch numbers etc, so that number may be in the right ballpark...

the sad fact is that the BCI will set an easy exam and pass 95% of the people appearing. compare that with countries abroad where the pass rates are between 20 to 40%. what an eyewash this exam is! the indian legal system is in a mess because we have donkeys becoming advocates. it's a tragedy that #31 and all the fools/lazy people against the bar exam will become advocates.

Friends, I am a qualified lawyer with over 5 years of experience.

I'm nowhere connected with AIBE but I am deeply pained and anguished with the way BCI, Mr. Gopal Subramniam & Rainmaker have treated India's promising law graduates across the country.

The decision to conduct a Bar Exam like this is legally flawed, in violation of Advocates Act & BCI Rules and against S.C. Judgement and the spirit of Constitution including the fundamental right of a law graduate to practise law under Art. 19.

If an MBBS graduate or a C.A./Architecture passout gets a right to work and practise just after getting his degree, why LL.B. graduates are being forced to write an additional exam?

Don't you think, the best way to improve the quality of bar is to improve the quality of legal education and not by introducing such an 'Open Book' / MCQ/OMR exam with 6-7 objective questions in each area?

I find the quality of a large no. of questions in this so called AIBE is nothing more than LL.B. Entrance Exams of the country.

Why this joke? Why Mockery of Indian Legal Profession? Why doubts over quality of Indian Law graduates? Why doubting your own legal education system in spite of improving it?

Mr. Gopal Subramaniam, with all due respect is MISGUIDED by vested interest groups. He acted in haste and hurry. This is not the way Exams are conducted in India. See, UPSC exams or even CLAT for that matter.

He must rise to the occasion to have courage to postpone the exam for once and for ever and do it in future with legislative backing and adequate systems in place.

And, Law Grads, My dear friends, if the exam happens, there is no need of preparation as such, take Rainmaker Books to exam halls, all questions would be from there only and almost every one 'll pass. Later on, this exam 'll be scrapped once matter taken up by Hon'ble SC...

I do not know from which University/College you have passed your Law Examination...It seemed so easy there,probably you cheated or gave open book exams.

For judging the "Analytical Mind" of yours not only AIBE but also Mensa/IQ test is needed.

We can club such Intelligence Tests with AIBE.

sitting in delhi and bombay , it is very easy to comment for the entire northeast their is one center , for the entire west Bengal there is one center and till now no venue has been prescribed . people have to travel a long distance to give a single exam of no value.why not each and every student be allowed to give their exams in their own districts . this is just a mockery and irrelevant expense of money ...

We are protesting the way it is being conducted for the interest of the certain vested business oriented people.

We do appreciate the move of respected G.S to upgrade the Legal System of India.

Dear Mr. Kianganz,

If you have any news regarding the AIBE case in SC? When they gave the next date? The Bombay HC gave tomorrow's date i.e. 24th Feb.
BCI is creating unnecessary tension among the students. Supreme court is also not caring the issue instead of giving the judgement before the exam date.

Lex Suprema appears to be a dummy of Rainmaker or a law student crazy about AIBE.

1. You need to understand, after passing all papers of LL.B. 5/3 years course and getting your degree, you get a statutory right under the Advocates Act, 1961 to be enrolled as an Advocate. BCI is wholly unjustified in taking away this statutory right of every law graduate without any legislative backing. Shame to BCI.

2. @76, Read my post at 40 carefully.

3. A mass boycotting of the Bar Exam is undoubtedly a correct and democratic solution. BCI and Mr. Gopal can't dare to debar all law grads of the country from practice. BCI is not above the Supreme Court.

But, as India is not Egypt. Young Advocates can't unite enough all over India to do a major or mass boycott, it is better to appear and write the exam. When they have wasted and disturbed you for a whole year, let it be for one more day. All of you 'll pass, for sure!

As said by you, its not the question of "we co-operating and sharing bte burden". Please dont try to give a regionalistic and a petty interpretation to everything, it just shows how narrow minded you are. Try and look at the larger picture. Mr-78 my point was why make a person travel 100 km to give an exam???it could have been arranged in district level with the help of state bar councils.
Secondly using the derogatory F word in public forum is totally derogatory and u should be apologetic about it
and if I have probs regarding the exam why shouldn't I be complaining , most of the north east not have train lines..and its hard to travel such long distance when the venue is not even fixed that was my point .

And if no one is complaining I should also keep quite what kinda logic is that

Mr. 77 i am sorry if i have hurt ur feelings. But every1 has their own view point ..even u hv that. There s no need to get so hard on that point...AIBE may be legally not on good footings...but
Plz understand my view point...I said since SC is not taking up the matter and BCI will not call off the exam....
and none of the poli/non poli leaders are intervening in this matter..

What we can do....other then preparing?
u will go for boycotting the exam...I bet u will start the boycott movement but the next min u will ur alone...Brother i have been in politics so i know wot boycotting/dharna and all these works and means..

But still if u think u can arrange then go ahead we will support u.

The nature of comments this post has attracted (Advocacy Act???!!!) only goes to highlight the need to have an all-India level bar exam for the so-called "lawyers" that this country generates every year. This does not however justiify the absolutely callous manner in which this exam is being conducted by the BCI. Only one centre for the entire North-East with the venue details still not known, non-availability of reading material, and the fact that the exam is being held nearly a year after most students graduated from university thereby depriving them of nearly 1 year's livelihood are only some of the problems with this exam.

So instead of cribbing about your problems, better startfacing it (read start studying for the AIBE)...if you say you havent recieved the material, if you can access Legally India and comment here, you can likewise go to the Bar Council's website and see the material there. Anyways, all the best for your future!

i would say those who r not supporting the exam they sh show their words in action if they can ever.....and those who r supporting exam they dont deserve to come to court ever..as they r far far away from practicality

how unfortunate this is that BCI is shifting its responsibility on the students.... NLU's hv good faculty who can train the students well....and no every1 can afford to study in NLU's (economically and merit wise) So those who graduate from traditional colleges ..where faculty r not that good...they r not interested in taking classes.... so in such condition how the students r expected to learn the law aptly....* Dont u think that BCI should hv taken steps to fill the gap there? * Does it mean that only those who can afford to study in NLU's only hv the right to study law and practice?
Equals sh be treated equally and unequals unequally ..this is the principle of equality enshrined in Art 14. So BCI first put the students passing from traditional colleges equal footings with the NLU's guys then go for exam and testing merits.. So students passing from traditional college hv to learn the law in a better way wh they come for practicing... In practice we hv to gv exam everyday ..becoz if u dont know the law u cant open ur mouth in court ...... So wot purpose the exam will serve other then filling the vault of BCI ..i fail to understand.......

I would appreciate if legally india would give us updates on the Notice of Motion No. 54 of 2011 in Writ Petition (Lodg.) No. 2255 of 2010 (the one writ petition pending in the Bombay High Court challenging the AIBE) which is listed regularly on the cause-list for hearing. It was first listed after admission on 14th Feb, then 23rd Feb and it is now listed on 28th Feb at Serial No. 22 before the Hon'ble Chief Justice. It is to be noted that Bar Council of India has not been attending the hearing on any of these dates. The orders passed on these dates are available on the website of the Bombay High Court. I request that legally india updates us about the developments in the aforementioned matter, if any.

BCI's AIBE apllied to:
1) Only advocates of 2010 batch can take this AIBE exam

2)If these advocates do not clear this exam they do not get Practice rights.

3) These Advocates can attempt this exam any number of times

Overlooked factors:
1) If Advocates do not clear this exam, they cannot practice.

2) These advocates will not be absorbed in any law firm.

3) These advocates have an option to work as legal officer in Companies. But they will have to surrender their Sanad.

4) If they surrender their Sanad they will not be able to attempt this AIBE exam.

5) If these Advocates keep attempting the AIBE Exam with no earnings, what is the use of 3 years / 5 years legal education?

Did BCI give a thought to this kind of a situation?

Your hypothetical situation just begs the premise. If you don't clear the exam, you're deemed not being worthy enough to practice. There's nothing the BCI has overlooked here. It's the definition of an entrance exam.

BCI is playing a game more coward. BCI is conducting this AIBE in arbitrary manner by NOT providing re-valuation system. why doubt our intelligence? BCI should implement a difference in the quality of education emparted to students in the college level. They cannot create an obstacle to a particular batch of Advocates by forcing one-sided rules invented by them overnight.

#98 Dear frnd i hope u willa ccept that a 3 hrs test is and cannot be a test of legal skill and ability of an advocate...if it was so then the members of BCI who r also advocates has none appeared for ny such kind of exams...I think u r more like the drafters of our constitution who finds foreign conditions and ideas more lively then wot they hv in their own country......Wot u r speaking may hold good in 1st world countries where there r many ways of sustaining life..unlike India. So use ur analytical brain and plz understand the Indian conditions...
And i find u so v adamant in accepting the hard reality that AIBE will hardly serve ny purpose..

who can not differentiate an entrace examination with a professional examination have no right to talk about AIBE.

If a 3 hours test can suffice right to practice then in coming years you will have many new law colleges at street corners and University courses should be shut down eventually as it is mere wastage of time and money.
Join only crash & trash courses.It may gurantee to to practice.

Guys no one in BCI or BCS have any concern about our life.... then y should we support them.... lets boycott the BAR COUNCIL ELECTION ( which is to be held during the month of March)!!!! y should these ppl be elected..... if they are concern about us then we are also not concer about them.. let stand together..... they only want to make money by putting our life on risk.....

So now we write exams to enter the law schools and then after we leave the law school because we successfully passed out and they probably dont believe the grades of our law colleges which they only provide the accredation to!! Name one other profession doing this to its pass outs!!
