The Bar Council of India (BCI), hot on the heels of having announced the banning of Indian one-year LLM programmes and a greater focus on continuing legal education (CLE), has announced that through the BCI Trust it would start an Indian Institute of Law (IIL) in Odisha’s Bhubaneswar, under an MOU with with the Kalinga Institute of Industrial Technology (KIIT).

KIIT, which also operates a private law school, would supply the land in Bhubaneswar and pay for 40% of the costs of infrastructure development of the new campus.

The IIL was launched by BCI functionaries on 29 January and promises to be a “model institute of law teachers’ academy, continues legal education and research”.

Further details about its exact purpose, ambit and the financials are a bit sparse on the ground at the moment.

The IIL would be “primarily for the teachers of law”, according to a BCI statement, however, it also stated that it would be the first of its kind “training institute in law to cater to the needs for skill development of the law teachers and the advocates”, allowing them to “enhance their expertise and professional skill and acumen”, suggesting there is also a major continuing legal education (CLE) angle.

Orissa Diary has carried an article that looks like it might entirely consist of either the BCI’s or KIIT’s press release or a speech at the launch (see full text below).

The announcement does not yet appear to have been covered widely outside of the Odisha regional press, except for in the New Indian Express.

According to the statement, the BCI had long planned to start an ILI but “it could not be materialized earlier due to one or other reason”, until it “finally contacted” Dr Achyuta Samanta, the founder of one of the more well-known private universities, KIIT, and its law school, as well as Lok Sabha member for the regional Biju Janata Dal party.

Update 31 January: KIIT was also awarded the Institution of Eminence (IoE) designation by the Government.

Samanta tweeted that this collaboration was a legal education “landmark”, adding:

I am glad that for the first time in India, a Government body has come forward to collaborate with private university to establish an institute of National importance.

This has set a precedent for times to come. We are fully committed to provide all requisite assistance in terms of land and infrastructure to supplement the BCI’s funding.

The apparent BCI statement noted that KIIT “provided requisite land at the prime location of Bhubaneswar” and would “bear 40% of the cost of the infrastructure of the proposed campus of 1.5 lakh sq. feet”.

That appears to imply that the BCI Trust would pay for the remaining 60% of infrastructure development.

The BCI release also name checked that the BCI Trust had founded NLSIU Bangalore in 1986 (which had happened under the visionary chairmanship of the late senior counsel Ram Jethmalani).

BCI chairman Manan Kumar Mishra (whose tenure as chairman is expected to exceed Jethmalani’s in length in the coming months), praised the collaboration in an interview on Kalinga TV confirming that an MOU had been entered into with KIIT (see 3:11 minute mark for Mishra).

The BCI joining hands with a private institution to offer professional training is a novel and interesting development.

However, if such collaborations between the statutory authority that exclusively regulates India’s lawyers and law schools and a private university are to become more common, it is not clear whether a tender has taken place or would be in future similar arrangements.

We have not been able to confirm whether any other private or public law schools or organisations had applied or were eligible to start an IIL; it is also not certain whether any consultation have taken place with academics or other stakeholders before the BCI embarked on its latest venture.

The BCI’s prior conduct and the surprise announcement suggests that a tender this time was probably unlikely. The first All India Bar Exam (AIBE) contract in 2009, for example, had not been tendered, and the tender for the second after 2012 was questionable, at best.

And in 2016, the BCI had passed an order forcing law schools to buy products from a private publisher nine months after that publisher had sponsored the BCI’s 50th jubilee celebrations.

The below prima facie appears to be a statement from the BCI or chairman Mishra, or perhaps a partial transcript of his speech at the launch event.

Considering the paeans included at the bottom, the latter option seems most likely.

The Bar Council of India is a statutory body created by the Parliament under the Advocates’ Act, 1961 to discharge the functions of regulating and promoting Legal Education and Legal Profession in the country.

The Bar Council of India through its Trust namely “B. C. I. Trust for Promotion of Education (Legal & Professional) and Reforms in Law and For Improvement of Research and Social Training”, has taken the initiative to establish the “Indian Institute of Law (IIL), a Model Institute of Law Teachers’ Academy, Continuous Legal Education and Research. The academy would primarily be for the teachers of Law. The IIL would work in collaboration with Kalinga Institute of Industrial Technology (KIIT), the famous Deemed University at Bhubaneswar in the Stateof Odisha.

Till date, there is no Training Institute in Law to cater to the needs for skill development of the Law Teachers and the Advocates. In the Indian Institute of Law (IIL), the young teachers of Law Schools of India and Advocates would enhance their expertise and professional skill and acumen.

B.C.I. TRUST had earlier established the iconic institution for Legal Education namely, National Law School of India University (NLSIU) at Bangalore in the year 1986, which continues to be the model Law University of the country. This will be the first of its kind in the entire country. Such Institution was long contemplated by the Bar Council of India and its Trust.

But the idea of B.C.I. could not be materialized earlier due to one or other reason. The Bar Council of India and its Trust finally contacted Dr. Achyuta Samanta, Hon’ble Member of Parliament (Lok Sabha), a great visionary, Academician and Founder of KIIT & KISS, Deemed Universities and after visiting both the campuses of KIIT and KISS, members of the Bar Council of India decided and resolved to establish the Indian Institute of Law (IIL) at Bhubaneswar, Odisha in collaboration with and support of KIIT University. B.C.I. Trust has entered into an MoU with KIIT and accordingly KIIT has provided requisite land at the prime location of Bhubaneswar (Patia).

This apart, the KIIT will also bear 40% of the cost of the infrastructure of the proposed campus of 1.5 lakh sq. feet area.

There is no doubt that the establishment of IIL will have far reaching ramifications in the field of legal education by reinforcing the position of the State of Odisha and India in the map of global education. It would be a great achievement and pride for Odisha in particular and the Country in general.

Indian Institute of Law will administer and run various programmes for Continuing Legal Education, professional skill development programmes, refresher courses, and learning courses for Alternative Dispute resolution methods viz. Mediation and Conciliation. Under various centers of learning; it shall undertake research in all aspects of law, justice and social development.

It shall publish case books, periodicals, digests, magazines, newspapers etc. (both in hard copy and soft copy through online and offline means) on various law subjects for Lawyers undergoing legal training and Legal education for the purpose of Continuous Legal Education.

The Institute shall organize and conduct seminars, symposiums, Training programs for Advocates, Academicians and Judges.

It shall collaborate with National Law Schools, other good Universities, Professional Bodies, The Judiciary, Government Departments and NGOs from within and outside India, and with different Bar Associations, State Bar Councils and Institutions of Eminence in India and abroad or other organizations connected with legal work for advancement of its objects.

The IIL shall have the following units at the initial stage :

(i) Academic Staff College (ASC)

(ii) School of Continuing Education (SCE)

(iii) IIL Training Centre (IIL-TC)

(iv) Center for Legal Aid (CLA)

(v) Bridge courses for Foreign Degree-holders.

The IIL will constitute General Council, Executive Council and Academic Council and will have adequate representation from the Higher Judiciary, Government, Ministry of Education, UGC, Academicians, Senior Members of the Bar, the Chief Justice of Odisha etc.

Bar Council of India shall be carrying out all the programmes of the Institute on its own for the initial 3 years. After that, some National Law Universities/other Institutions with good infrastructures will also be allowed to impart the courses on the pattern of IIL.

We have resolved to actively involve and take the aid, assistance and guidance of Hon’ble sitting and former Judges of the Supreme Court and High Courts, Renowned Jurists and reputed Senior Advocates, eminent leaders of the Bar and persons of eminence besides noted Law teachers of NLUs and other renowned and academicians. They will be the Full time Teachers, guides and/or Honorary guest teachers.

This apart, B.C.I. Trust shall also invite noted Law Deans, Judges and Members of Bar from countries across the world for the aforementioned programmes. All the above noted Legal giants shall share their pearls of wisdom and experience which will not only benefit the law teachers and law practitioners, but also provide them with a wonderful opportunity and platform to interact and learn from legal luminaries from India and abroad.

We believe this Indian Institute of Law shall be a landmark in the history of legal education and legal profession which will greatly aid in the dispensation of law and justice.

We are grateful to Dr. Achyuta Samanta ji, the distinguished educationist, philanthropist and founder of KIIT and KISS Deemed to be Universities, who has accepted our proposal and has provided through his Trust such a valuable piece of land at Bhubaneswar for the establishment of this Novel Institution. Indeed, the coming generations of Lawyers would be indebted to Dr. Samanta.

Yes, Dr. Samanta is really a messiah for the poor tribals and education seekers. Why do you mean "supposedly created"? Please read the Karnataka High Court' ruling. NLSIU is a pure BCI creation. In the present case, KIIT was possibly chosen because of availability of land and the promise to share funding. Which NLU could do that?

Yes, it has been challenged in court by a student of Symbiosis. The NLSIU reservation case in the SC will also settle the question to an extent, as NLSIU/BCI/ASG Vikramjeet Banerji are arguing that NLSIU is a class apart from other NLUs because of the BCI connection. Karnataka HC upheld this view, while the Cal HC missed a chance to rule on it as the NUJS petition fizzled out.

It's very easy how KIIT got IOE status. Among private universities which applied, BITS, Manipal and Jindal would have made it anyway, while Jio made it because Ambani owns the country. 4 slots taken at the outset. From the rest, Ashoka and Azim Premji were ruled out for having "anti-national" leftist faculty, while Krea (greenfield university) was ruled out as one of the top anti-nationals (Raghuram Rajan) is its chief mentor. So KIIT made it by default. Remember also that Achyut Samanta is an MP from the BJD (which supports NDA).

Please note: BCI Trust has also proposed the establishment of an international law university (ILU) in Goa in partnership with NLSIU. Goa in the West, Bengauluru in the South and Bhubaneshwar in the East will form the golden triangle of Indian legal education, administered by BCI Trust. Each will have a different function.

Readers of this website are totally ignorant and foolish. The news report is also ignorant. BCI Trust is a fully autonomous body with full freedom for collaboration with any public or private body in India or abroad. Decision to start IIL was taken after it was felt there is a shortage of good quality faculties in NLUs and other law colleges so they need training. It is very difficult to get land in India. KIIT made a generous offer of free land and partial funding of construction, which is a dream offer. So KIIT was chosen as venue for IIL. No other college made such an offer. One must look at UGC rules also. KIIT is having status of Institution of Eminence with freedom to set up a body like IIL, which NLUs do not have. Private colleges like Amity and Symbiosis also do not have Eminence status. You look at ranking also. Apart from Eminence status KIIT is having 12th rank in NIRF, ahead of many NLUs. There is one other law school with Eminence status (Jindal Law School) but it has no rank in NIRF and its a law school for richest section. In comparison KIIT is for all sections and gives scholarships to tribal students.

If the UGC Regulations about PhD being the minimum qualification necessary to score a permanent teaching job is implemented from this year, then I really doubt any of the actually talented students are going to hang around in academics for so long. Only those who don't have any other option career-wise, or those with no financial concerns would stay back, which used to be the same case 10-15 years ago. The supply of young, bright law grads with fresh masters and maybe a little work experience coming to teach the next gen would dry up quite readily.

Also, it seems KIIT and its "messianic" founder (plagiarizing the look of national Messiah) have done a good job in scrubbing the internet clean of the fact that only a few years ago, expert committees appointed by MHRD under SC directions had blacklisted KIIT among other private and govt universities who had been provided "deemed university" status by a Arjun Singh-led MHRD earlier.

KIIT brought in several former UGC, AICTE, DST etc honchos (almost as soon as they retired) and was soon on track to become IoE. And we all know how the IoE got going and was ultimately done.

In the olden days, most of the BCI chairmen were luminaries from metro cities with good Supreme Court practices, often a former Attorney General/Solicitor General. For example, Jethmalani, Setalvad, CK Daphthary and SV Gupte from Bombay, or Niren De from Calcutta. More recently, we had Gopal Sub from Delhi.

Sorry if I sound elitist, but we need a return to that system.

Just came across this very interesting thread on LinkedIn by Prof Dam. I kinda agree that law schools need to be doing more by way of empirical research. Even if KIIT can create law teachers I think NLUs will be needed for good research

Completely agree with the need for legal empirical research in India. In fact, I just got to know the other day from a friend who is teaching at an NLU now about some great empirical work that they are doing about judicial reversal rate. They even tied up with alumni who are attached with foreign universities for this work. From the brief description that I got, it is going to be a big thing if all goes well.

Of late, Legally India is doing a lot of "play safe" journalism. Kian will detect a scam , but go lightly on criticising anyone and be diplomatic. Why would an NLSIU grad after having minimum 5 years of law firm experience be interested in this job? It's limited to India and after 5 years in any tier one law firm, they would make much more than 20 lakh p.a. It is also laughable that an organization singles out a particular educational institution for a mid-level job. Goes to show the frat boy culture there rather than anything else. Must be that the supervisor is from NLSIU himself. In either case, why bother to place an ad then? Just send it to their alumni group and save money!

It is because of the emphasis on "'absolutely excellent English" that the organisation only hires from NLSIU. Let's be brutally honest: the more caste/domicile/EWS quotas you have in an institution, the more likely that you will attract people from non-elite backgrounds with weak English. Since NLSIU has no OBC/domicile/EWS quota, fewer students there tend to be from such backgrounds compared to other NLUs. Sudhir himself is the only NLU VC who speaks and writes excellent English and the only VC from a privileged background. This is why Sudhir is furiously litigating and lobbying to be recognised as a special institution, to the exclusion of other NLUs. Sudhir is the complete opposite of Shamnad in this way. Shamnad tried to involve multiple NLUs in SpicyIP and IDIA, and filed the CLAT petition treating all NLUs uniformly. Sudhir treats other NLUs as Shudras and Dalits. I haven't found any problem with the English skills of Faizan, RS, the current GNLU VC, or Poonam Saxena either. Or the current TNNLU VC. I have also met NLSIU graduates with sub-par English vocabulary and grammar. Just like those from other NLUs.

Really? Then I guess having the majority of the batch from the cow-belt of India who are renowned for their poor English speaking skills is quite an asset for NLS. Not to mention the lack of gender and socio-economic diversity at the place. Fools like you should realise that this is a different era of legal education compared to the previous decade. Sudhir doesn’t come from privilege. He basically finished his schooling on charity. His parents were not even upper middle class- and they don’t speak English, they migrated to bangalore and his father worked in low paying jobs. He’s a rags to riches story if there was one.

It’s counter intuitive because he’s a Rhodes scholar- but keep in mind that not many folks were applying to that all those years ago. Nls was barely a brand when he got it.


He has also championed students from disadvantaged backgrounds while at Apu and before. I am one of them. Just anything you will say?

Yeah, man. He was donning all those rags every morning while studying at St. Joseph's. Pull the other one, that's got bells on. NLS already had 7-8 batches out when he got it, so your 'not a brand' argument does not hold either. As for him championing the causes of students from disadvantaged backgrounds, that's utter rubbish. If you got his help, then it is because he had taken a liking to you personally, not because of your background. Every single decision that he has taken since becoming VC has been elitist and pushed back the cause of the disadvantaged students for miles. Your anonymous anecdotal whitewashing claim doesn't really wash in the light of all that. Before APU? What do you know about him before then? He was at NUJS back then, and he wasn't even involved in arguably the greatest movement in the NLU sector for underprivileged, despite a fellow alumnus from NLSIU heading it.

Not everybody who studies at St Joseph’s is wealthy. A little knowledge can be a dangerous thing. Many students were admitted with scholarships/ fee waivers. It’s a charitable institution.

Nls had exactly 5 batches graduates when Sudhir started- that’s hardly a brand. Brands take time to develop. And I would say maybe 2005- onwards batches took advantage of it- but not the 1998 batch. Nls was still a small but optimistic experiment when Sudhir graduated.

It’s only your opinion that he’s been acting against the interests of poor/ marginalised students at nls. I’ve been in touch with others who think he’s doing quite a lot of good.

But it’s pointless arguing when someone is so angry for whatever reason.

I was not the only disadvantaged student Sudhir supporter at APU- he worked with and gave opportunities to a number of us and fought for us when it was necessary. Sure nls doesn’t have the funding Apu does- but his actions at Apu do speak to his character.

I’ll leave alone the shamnad stuff because I don’t want to speak ill of the dead. Suffice to say there is plenty wrong with how idia is run and who shamnad promoted and mentored.

Of course, there are plenty of things wrong with the way IDIA is being run, and not a single thing wrong with the way NLSIU is being run. You've made your allegiance clear. Sudhir was living off charity, which is why he's now so charitable towards others. And no, you don't have to take my word for Sudhir's actions, unlike the way you are asking others to take your word for his benevolence. All the actions that I refer to, ranging from withdrawal of scholarships to extorting fees for convocation that was never physically held, from holding a random entrance exam and inconveniencing thousands of students and having the temerity to retain 50% of the fees even after the exam was cancelled, from turning CLAT into an even more elitist exam and then offering tuition courses for school going students for CLAT, all of his actions that I speak of are matters of public record. Whereas all you still offer are vague anonymous anecdotal references. The relative merit of our arguments are pretty obvious to any impartial reader. As someone who has actually been associated with IDIA, I can vouch for the fact that it has done legal education in this country a whole more lot of good than you or Sudhir has ever achieved, your insinuations notwithstanding. Sorry, pal, but privilege in India is not merely a question of economic affluence. The social status is equally, if not more, determinative of one's ability to succeed. Correct me if I'm wrong, but he's a brahmin guy and there are many unspoken advantages that come with that, including his ability to place himself on the pedestal which he has put himself on at the moment. And back when he came to Bangalore, most of India was considerably poorer and of lower-middle class anyway (even upper castes). So with all due respect, his isn't some Ambedkar-esque fairytale journey to the top.

I don't really know (or care) about what he did at APU because it's a private university and the access to resources there is lot different, but his policies that I have heard of so far from his time as NLS VC have been arbitrary, elitist and (at the very least) ill thought out. Contrary to the nonsense that most of these NLS trolls keep spewing here, I think NLS under him could have helped improve the situation of legal education in the country if he really wanted to. Instead, he has chosen to adopt a self-centred myopic vision of excellence in legal education which in all probability will end once his tenure as VC ends.

I didn’t say he was the most deprived person in the country? But among other people in his school and university- he was definitely among the poorest.

Most of India is really poor even today. That doesn’t mean that people who manage to work their way out of it didn’t endure hardship. And no his parents came to Bangalore fairly late.

It’s not surprising that you’re not interested in knowing about his work at APU. Ignoring facts that don’t suit your prejudice is quite normal these days.

The trolls attacking Sudhir are shameless and disgusting. People with such hatred and malice within them need serious psychological help. I am appalled that Legally India is not banning these comments. In a way, these comments sum up everything wrong with India. A brilliant mind gives up comfortable life abroad and returns to serve the country. Instead of praising him people are attacking him. What is his crime? Trying to improve standards at NLSIU by hiring alumni educated at top universes abroad? Tie-ups with companies like GE? Improving the website? Trying to crack the QS rankings? Challenging domicile reservation to preserve the national character of NLSIU?

I am also shocked at the personal slander. He is not from a privileged background as is being projected. Shame on the person who brought caste into the equation. There are many brahmins living in poverty and many SC/ST/OBCs who are millionaires. Sudhir has done more to help underprivileged students in 1 year than other VCs have done in their lifetime.

I could tell you what he did at APU, more than half of us were given need based scholarships. Sudhir gave us all a chance/ he didn’t need to. Sudhir set up English writing and research programmes to help us do our work. He was constantly available.

From what I know he’s continued the English programme in nls also.
That’s actual work- it stays with you forever.

I also had a friend who was going through some difficult times and Sudhir literally made sure someone stayed with them after school to complete their work.

He also encouraged students from across class and caste divides and involved some of us in his research projects. He’s a good guy.

The English programme has always been there at NLSIU, Sudhir didn't introduce anything new. His APU exploits are not really relevant at this stage. He has not done anything to help the marginalised students at NLSIU and is turning that place into an even more elitist one with his policy decisions, which is a fact. As for availability to students, now that's a joke! He has got to be the least accessible VC for student issues in the past 2 decades!

What English programme at NLSIU? I was among the last batches that left under RVR, there was no "English class". We were made to sit an MCQ-paper in 1st year (which everyone passed), and based on that, NLSIU just checked the box on BCI's mandate to have English as part of the course.

Faizan Mustafa does not have many years left at NALSAR. I have no doubt that he will enter politics after that. Unlike VCs like Menon, Baxi, Singh and Chimni, Faizan has not used his time to do serious legal research. Rather, he has publicised himself and become an influencer, through YouTube videos, TV appearances social media posts and news articles. He has made it very clear where his political sympathies lie. Ideally, he will want a Lok Sabha ticket from his home state (UP) or a Rajya Sabha nomination. But that will be difficult and competitive. An easier option could be a Vidhan Parishad seat in UP (upper house of the state: UP is own of the few states which has a Vidhan Parishad).

Among former VCs, the only one who has been openly political and joined a party is Mohan Gopal. He is a key advisor to Rahul Gandhi
