SC bar exam hearing: delayed one more day by admin

Today’s hearing in the All India Bar Examination (AIBE) matter has been postponed by one more day following an inadvertent administrative delay in sending the case files from the Supreme Court Registry to the registrar’s court.

The contentious matter is now scheduled for hearing tomorrow before the registrar. As per the registrar’s last order dated 25 October, today the petitioner BCI (Bar Council of India) was supposed to file the proof of service of the notices meant to be served upon the respondents.

Senior advocate Dushyant Dave’s assistant Anirudh Rajput who was present in the court today told Legally India that they have filed an interim stay on the exam on behalf of law students in Maharashtra.

In June, a group of students from an Aurangabad-based law school filed a writ petition against the BCI through their counsel Satish Talekar.

Law graduate Siddharth Seth and Rajput confirmed that in another development in the case the Madhya Pradesh Bar Council has planned to move an application for impleadment as respondents along with the Maharashtra law students tomorrow.

i did not received the material from bci of aibe.is this the reform bringinig by bci,is this tactics r training by bci to us newly enrolled advocates,is this bci is improving the legal standard,

@4-Shut up ! You, proxy counsel for Cloudmakers. What a mockery of justice and administrative incompetency at the Apex Court level .The students are not opposing the bar Exam but opposing the unfair practices adopted by the the BCI to benefit the Cloudmakers and not the legal profession.In fact ,the BCI and the Registry of SC needed to appear at the Bar Exam.The students are opposing the Dadagiri of BCI and the Scam involved in it. Tomorrow we would get stay.

...and with that, all hopes of a stay are gone. The Registrar's Court has no power to stay any exam, Court closes for a week thereafter, and the registration deadline for the Bar Exam is the end of the month. The matter will therefore become infructuous.

Is there any possibility of getting stay for these exams.. after all wat are these exams... we dont have materials wid us... god only knows wat has happened to our appl we had sent whether its reached or not... one month for exams and students waiting for materials for preparation.. its ridiculous...look how Board of studies of CA, CS, CWA conducts exmas...is this professionalism??

When i inquired from the court staff about this petition of ITEM NO. 10 on 25th October, they said that we have no file here thus it has been listed before the CHAMBER JUDGE.
Now how come it is still with the Registrar. The BAR COUNCIL OF INDIA people have missused there powers.

Rightly pointed out by # 7 that the last hope for justice and stay is gone. Since Registrars court has no power to do so i think. But this all the way proved that BCI and rainmaker could not have proved their action legal so they took reufge to such delay tactics. one thing i will mention here that Above all there is "justice of nature" and no one has a hand on that... BCI will surely not be pardoned there.

What use is this exam to us? Nobody becomes a Master of All the subjects. Moreover, by bringing this impediment BCI is unjustly preventing our earnings. The bar exam will have no revaluation. Which means, complete arbitrary action. If they want to introduce this exam, then it should be for the ones who take admission for law in 2011-2012 onwards. This way, a student is aware of the impediment that they have to encounter before practicing. If the 2009-10 batch students knew of this obstacle, maybe some students would not have opted this career. What BCI is doing now with the 2009-10 batch students is unpardonable. BCI is forming the thick dark atmosphere for the Rain.....maker by making the 2009-10 students pay Rs 1300/- for the exam with no study material in sight for more than a month after sending the draft. They expect the students to pass by studying 20 subjects in ONE month (or for all we know, they want the students to fail and so are delaying the supply of study material and helping Rain.........maker to make more rain down the years).

Agree that the way the exams are conducted and not the exam itself, is the main issue here. However, I have seen that many have complained about materials not being available. Didn't Kian provide a download link to all the matierals as soon as they had come out? I understand that those without any access to internet have a legitimate gripe, but those who can come to LI and post comments can perhaps also simultaneously start downloading the materials through the link provided on this site as well??

#15 can u please tell me, when a plane is hijacked, does everyone passenger have the courage to overpower the hijacker? Maybe a couple of them............right? So does that mean, that the rest are supporting the hijackers?

If we are able to access the net and write on this website, you don't have to direct on the downloading of files and taking prints. If that was case, we students can tell you how to organise the exams in a well planned and orderly manner for the welfare of the legal system. Right now, BCI is making a complete mockery at the cost of students of 2009-10 batch for whatever reasons best known to them.

Each of us are 23 years old plus and with the kind of impediment BCI has invented, does this not mean, that the students of batch 2009-10 are expected to only keep attempting this so-called FIRST AIBE until they Master all the subjects as BCI does not provide for revaluation option in this exam. So they are not even accountable for this exam and students future is totally bleak. We have no idea how many more years we may have to keep attempting and fighting this unjust treatment.

Right now, we are the voice of many who have no access to the net. We are speaking what is just. None of the students of batch 2009-10 are afraid of taking the so-called FIRST AIBE. But if the same is conducted in unjust manner, please do not expect us to take it quietly.

BCI promised to provide study material.
It is very difficult to study from computer screen so it is needed to be printed..another huge cost.

Why we are paying Rs. 1300 then ? What BCI & its Chairman is doing ?

Only some points are jotted in study material..Is it of very good quality ??

CBI inquiry required to nail those playing tantrums as they defied all norms to conduct examination for personal monetary gains.

@ 18 - if bar exam will be easy then what is the purpose of such exam ? If u compare it with NY bar exam then people flunk even after several months of preparation ... that is what known as a bar exam !!

It is natural to oppose a change. But a change for betterment should always be appreciated. The question in opposing the Bar Council Exam is that whether there should be any change without going for the right procedure for change or not. One another question is that what the students are asking for ,it is only to adopt for the right procedure. One more question is the whether the justice is available in India to the Advocates if not then what is the status of Justice to the common man. Are the courts are doing justice according to law or courts are interpreting the law delibratly.

The stay is not listed today. Court reopens on the 8th of November. If you kids know anything about our courts systems, there wont be any stay of proceedings. You can either go and do the exam. Or listen to the likes of Faltoopal and Dave's assistant.

Are you giving exams ? Everyone passed out before and after should give exam including Bar Council Chairman that is also conducted by some foreign bar council like NY BAR where they cannot rig it.
Then there will be justification.

This Exam is mere misuse of power of a few that is also got by personal relations and connections.

Hoping for Justice is shamelessness today. Delay in Justice is also one type of injustice. In these days nobody stands on the side of the truth. Because it is difficult. People will remain on the side where they get something personally. In these days no body is accepting bribe to do anything wrong. Everybody is asking money to accept your truth, otherwise you are thrown for fighting for truth. And shameless people laughs at you.

You can understand what is the hope for justice in these days.

One side these kind of exams are very common in western countries for professionals. But as Rainmaker is involved every on in BCI is prone to have an undercut in our Rs 1300/-, so that is the reason why the dates for case hearing is getting post poned. If no one takes the exam and strike on it. There is no problem so let us boycott this AIBE exam. Hope for a stay.
