High court stays NLIU Bhopal domicile seat allocation that was quietly botched up in CLAT

The Jabalpur high court on Tuesday (23 June) stayed the downgrading of at least 15 Common Law Admission Test (CLAT) candidates who were allotted NLIU Bhopal in the first allotment list under the Madhya Pradesh state domicile category, but were later assigned lower-preference colleges in the second list.

According to Vikas Awasthi, one of the petitioners before the Jabalpur High Court, all 15 candidates were allotted NLIU Bhopal under the state domicile category when the first list came out on 9th June.

When the second list allotted them other institutes despite their preferences being ‘locked’, they protested before the CLAT convener committee at RMNLU.

The CLAT authorities had informed them that NLIU Bhopal had asked the CLAT convenors to change the published allocations, because they intended to give admission in the domicile category horizontally and not vertically as advertised in the CLAT brochure.

The Jabalpur high court stayed the change in allocations in the second list and maintained the status quo of 9 June, when the first list came out. While they are yet to receive a copy of the order, Awasthi said that they have personally informed both NLIU Bhopal as well as the CLAT convener at RMLNLU, and also sent mail to all 16 CLAT colleges.

Legally India had reported on 17 June how a number of CLAT candidates who had been allotted NLIU Bhopal in the first list, had ‘locked’ the preference by paying the Rs 50,000 counselling fees but were later shunted downwards rather than upwards in the second allotment list.

Only a few days later, without any apparent notice, NLIU then dropped 26 unreserved state seats that were advertised in the CLAT brochure, instead adding those 26 seats to the all-India unreserved category.

Oh for God's sake!! the Seats were not changed from Domicile to All India General ! They were changed from Vertical to Horizontal. Which was done way back when the first Clat Brochure was released. These 15 losers are just creating Nuisance and trouble for everyone. Kian please report correct facts.

Nope. In the first CLAT brochure, there were 26 seats for Domicile general. And now there is a blank there. Whatever terminology you use, ultimately the net effect was that those 26 seats are now in the All India category.

Dude go and check it again. It's not blank. You guys didn't make it into NLIU now stop being pricks about it. There were 26 MP students admitted through Horizonatal allotment . It's not a terminology dumbass. Stop misleading people and wasting everyone's time.

Nothing will happen after this even. The ball is in the court of the University. They had published the changed seat in January, so when the actual hearing takes place, this stay won't affect or rather get reveresed as happened at BOM HC. Nothing to worry. Anyway, these aspirants don't deserve to be at NLIU, who can't even notice that this new seat arrangements were notified through brochure of the University!

@NLIU Student and Anonymous: If all that's true and it's merely treatment of the reservation as a horizontal one, pray why these students had been assigned NLIU Bhopal in the First Allotment List to begin with? This is a classic case of promissory estoppel if not gross negligence, which I am sure you folks have learnt a little bit by now.

You know, you shouldn't spit shit out of your mouth when you don't know anything! The first list was wrong because they applied the vertical reservation whereas it was changed to horizontal which was brought to the kind notice of RMLNLU by the NLIU, which was then rectified in the 2nd round! All right?

Yeah, considering the NLIU VC is part of the CLAT Committee, it is so very believable that the 'mistake' of this stupendous sort occurred entirely without your VC's knowledge. If it did, then probably you may be better off with an administrative change, given the present one's incompetence. Also, unless you yourself are part of the CLAT Committee, or part of the organizing group, I fail to see how exactly you know anything, while I do not. And if I do not, just like the scores of the CLAT candidates this year, that is because of the opacity surrounding CLAT this year, which is exactly the point that is trying to be raised here.

Or you might be one of those 15 kids who are trying to force themselves to the law school where you don't deserve to be . Worse is you guys are throwing legal jargons which you have picked up in some legal reasoning module. Go read up on promissory estoppel man.

@NLIU Student: Apparently, you have not. If you did, you'd have clearly known that this is a case of official allocation of seats via the first list (promise), based on which students paid the not inconsiderable amount of Rs. 50k (which may seem too small to you, but I assure you that to a lot of people, it is not such a small amount), subsequent to which those students were told they have been downgraded (breach of promise). Whether that happened because of negligence, incompetence, or plain stupidity on NLIU's part or RMLNLU's is not the point here. Considering your VC is part of the CLAT Committee, even he has to share part of the blame for every mistake made by that Committee, given how your university is also going to get its own share of CLAT revenue. And without belittling your university, many of the alumni of which I have a lot of respect for, I have learnt about promissory estoppel from people much better even before the desire to join law school was a mere twinkle in your eyes.

Halo Mr dumb will you please give me the answer why all law universities gives vertical reservation for their respected state except nliu and rmnl. Why don't you try to abolish the vertical quota in all universities.

because vertical reservation is not judges on merits! Horizontal is nothing but removing the state domicile at 99%. Horizontal rules out or practically wipes out domicile quota because it admits those students who could've been admitted as All India General as Domicile quota as the case of rank 83 in NLIU. She has been admitted under domicile quota although she's the batch opener. It's another way of increasing all India seats which is a brilliant decision so far.
See NALSAR where a student at rank 701 got it through domicile, which is vertical reservation.
This is the difference!

Because NLIU is a college for excellence. The best deserve to study there irrespective of which state they are from. Don't behave like cry babies. The college has ensured that 26 domicile general students shall get admission into the college every year, which is more than fair. Also, yeah NLIU is better off without you people.

Nothing wrong with that decision, by the way. I completely support the horizontal reservation, as opposed to vertical. My only point earlier was that the CLAT Committee should have clarified it better much earlier and perhaps not assigned these students in the first list NLIUB in the first place?

@ outsider The VC of all the law universities do not sit in a room and make allotments. There is a software and a professional company which takes care of the allotments. Its true that a mistake was made by the people sitting at RMLNLU making the allotments . However any person who has had the brains to read the Clat Brochure would realise that NLIU had made the changes way back in December. By Your logic if tomorrow some rank 5000 guy gets allotted NLSIU because of some mistake or a software glitch which the college rectifies later he will still be allowed to study in NLSIU? Thats preposterous!

I will tell you whats the real story. These Kids have got the law universities they have deserved, but they now want to take advantage of a mistake which the CLAT Authorities made to power their way to NLIU. But, then I don't blame these guys, who would want to study in HNLU Raipur/ GNLU Gandhinagar when you could have studied in NLIU

@NLIU Student: Apparently, you are unaware of the agency principle. The VCs do not have do the allotment themselves. The external company was the agent of the CLAT Committee, which is why TCS is not being dragged into court for the CLAT debacle, the Committee is. And as I said, if your VC is a member of the Committee, he cannot escape liability simply by saying this is a mistake by RMLNLU or external companies, etc. And the students need not have read the brochure at all. If you remember the way the counseling had happened for you, there's nothing that prevents the 5000-ranked student from even trying to get through to NLSIU, right? Had the 'mistake' been corrected BEFORE the First List was out, or even before those students deposited the Rs. 50k, it would still have been legally valid. It wasn't. Which is where the question of incompetence/negligence is coming from.
What you mentioned as preposterous is actually legally valid to the extent of the kid having a prima facie case if CLAT accepted money from him on that pretext and refuses to give it back later.
The kids may be trying to take advantage, but they have been given the chance of doing so through sheer incompetence of the Committee, of which, whether you like it or not, your VC is a part. And whatever you'd to say, that could have been easily pointed out without belittling other NLUs; the fact that you chose to do so merely indicates your immaturity.
