124 morning courts get green light in Mumbai, Maharashtra

The Bombay High Court has cleared the way to set up 124 morning courts in Maharashtra by next week, with 20 being based in Mumbai. The courts will operate between 8am and 10am to increase the caseload the courts are able to handle, reported the Times of India. Maharashtra received Rs 542 crore ($117m) of a Rs 5,000 crore budget to modernise the courts, of which Rs 297 crore will go towards establishment of out-of-hour courts in the next five years, according to the paper.

Less than a month ago the Maharashtra and Goa Bar Council resolved to oppose to establishment of evening courts, which would unduly burden advocates.

Since bench and bar are two sides of the same coin that delivers justice to the litigant. Both must adjust and accomodate each other's point of view.Both must work as a team to mitigate the pain and suffering of the litigants. Even husband and wife can
divorce, but bench and bar can not.Partnership can be dissolved, but relationship of bench and bar can not be set apart. Both exist for the litigant, whose interest should not be compromised. It is good that HC has established 124 morning courts to reduce huge backlog. Let us welcome this new initiative.

when there are nearly 1 crore pending cases and the number of adnournments increasing to unacceptable limits it is time the supreme court take immediate action against lawyers seeking adjounments just to increase their sitting fees. Had the lawyers taken care to avoid seeking adjournments just for the sake of increasing their income the number of pending cases would be considerably less. It is for the purpose of reducing the ever increasing backlog of cases that the judiciary is trying to introduce novel methods like morning courts. the lawyers must welcome the move because it only increases their income.
