BCI misspells Justice ‘Chemeleshwar’ throughout lengthy post-retirement press release diatribe, on behalf of ‘99.9% of lawyers’

The Bar Council of India (BCI) has issued a press release slamming recently retired Justice J Chelameswar for speaking to the press after his retirement, explaining why he (and others) took the unprecedented step in January of calling a press conference criticising the conduct of their Chief Justice of India (CJI) Dipak Misra.

And, as the Firstpost noted in a full reproduction of the BCI’s release:

Aside from slamming the former judge for interviews given to the media, the press release also condemns him for the damage done to the Supreme Court of India by him. Further, the release consistently misspells his name throughout the course of its 500-plus words.

In April, we had fully annotated a BCI press release against senior advocate Indira Jaising with some of the BCI’s most memorable historical blunders.

Self restraint by the Hon’ble judges of the highest court seems to be a forgotten virtue. They have to prevent themselves from issuing statements without giving any thought to the consequences such statements could entail., The manner in which Hon’ble Justice Chemeleshwar went to the media and gave controversial and, irrelevant statements Immediately upon retirement, was not expected of a person holding such a high post and was infact against the dignity of the post he had held. Such statements and comments are liable to be deprecated. Such statements cannot be tolerated, accepted or digested by the Advocates including the rest of the countrymen.

Justice Chemeleshwar has resorted to usage of such controversial words like” Bench fixing”. Now if a handful of Lawyers of the highest court filed matter/ s and mentioned it before Justice Chemeleshwar and other chosen judges, and tried to get it listed, then that would have been “Bench fixing”. Such instances have been repeated not once but on two-three occasions. Justice Chemeleshwar should have raised an objection at that point in time. But Justice Chemeleshwar did not do so and, infact accepted and agreed to hear certain matters himself which led to the beginning of a wrong practice. Had such irregular or unlawful orders been sought to be set aside by the Chief Justice or by some other judge then there would have been no harm done. Before issuing any statements relating to judges meeting politicians, Justice Chemeleshwar should himself do an self introspection.

The fact that Justice Chemeleshwar met CPI Leader and Rajya Sabha M.P. D Raja immediately after his Press Conference, clearly deciphers the mystery and the motive behind the controversial statements being issued by Justice Chemeleshwar. The amount of damage which has been done to the institution since last January, would take a long time to be repaired and rectified. However, we have full and utmost faith that the Lawyers of the country, especially the younger generation would criticise and dislike such kind of statements and do their level best to salvage and protect the dignity and decorum of the Highest Court of the Land.

For the purpose of self consolidation and for fulfilling selfish and vested interests, not only some political leaders, but some Advocates and even infact some judges have attempted to misuse and malign the institution but they have woefully failed. It is the great fortune of the country that 99.9 of the legal fraternity and the judges have seen through this ulterior motive and mindset and such people who have attempted to bring disrepute to the institution for their vested interests, have had to suffer a setback at each step. The judiciary of the land is by far the holiest and the most powerful institution and in which even today, each citizen of the country has full and unflinching faith. Any and every judge should first do a self introspection and look at himself/herself, their actions, deeds before making or issuing any statements against the judiciary and they should make concerted efforts to safeguard and maintain the dignity and decorum of the institution.

....while I fully understood 99 people who are complete lawyers or judges, may I ask who could be this 0.9 lawyer/judge who is actually not a complete man/lawyer/judge and because of whom the total figure is 0.1 short of complete 100 persons/lawyers/judges!

manan kumar mishra is a specimen of what happens when you have a bad bar exam or no bar exam. This guy is sitting at BCI for two reasons: 1. he was erroneously allowed to be a lawyer due to a systemic failure and 2. he managed to avoid organizing BCI elections for many years

Manan Mishra has been involved in far more serious controversies. It will be better of you focus on them instead of these minor issues. His right hand man was convicted for taking bribes to recognise low quality law colleges. Then the bar exam controversy. He needs to answer some serious questions.

Like rest of the country, Judiciary is not from the Mars, it is we the people of India who are in Judiciary, politics, Medicine, Executive, Corporate and forces etc. etc. including BCI.
Not everything is ok with this country. Hence, we are all responsible for the rot. The rot, that resources are being abused mindlessly, ecology has been rapped and molested, corruption is looming high, POOR has no say---only BPL is his/her fight, youth are unemployed, corporate are looting public wealth in the broad day light. Present regime is spewing hatred against dalits and muslims. Reservation, in fact, was introduced to share the national resources with the communities kept out of the social, economic, and political sphere due to Manu's design by the so-called upper castes for thousands of years. Do they have control over natural resources; say land, almost entire owned by the so-called upper castes? It would take another thousand year to bring parity in the society, which was ruined by the upper-castes ignoring the Vedic wisdom, “Vashudhaiv Kutumbkam.”


Would there be any response from the BCI to the Hon’ble Mr. Justice Mahesh Chandra Sharma Ji, he also went to the press: "He called the cow 'as pious as peacock', which he said remains celibate and the peahen(female) gets pregnant after drinking the male's tears."
And would it be sane to declare that his above statement does not qualify, “Such statements and comments are liable to be deprecated. Such statements cannot be tolerated, accepted or digested by the Advocates…”


Because the press statement, peahen (female) gets pregnant after drinking the male's tears is in the line and with tone of the BJP and RSS duo. Since Pardhaan Sevak also said that Ganesh was designed by the Ayurvedic Surgery, and Tripura CM’s says Mahabharat-kaal invented Internet and… Sita-Mata, was the first test tube baby.
