Bombay HC sends judge in Bal Facebook critics’ arrest to outer Maharashtra

The magistrate who had ordered two women, who criticised Mumbai’s shut-down on Facebook after the death of Bal Thackeray last week, to be taken into judicial custody and later released on Rs 30,000 bail, has been transferred to Jalgaon in the far North of Maharashtra.

The Bombay High Court has ordered first class judicial magistrate Ramchandra Bagade to move immediately to Jalgaon from Palghar, which is in the Thane district near Mumbai, reported NDTV.

An inquiry into the incident has so far indicted the policemen involved in the action that was taken under the IPC and the IT Act and the Maharashtra home minister RR Patil may publicly comment on this later today [NDTV]

I will never understand this concept of TRANSFER as disciplinary action , "you have done something wrong here so now go somewhere else do the same thing" seriously what is this concept .....

Having said that, such a person who has been transferred will actually stop doing work and will not take any decisions whatsoever. He will start imputing sinister motives to anything and everything in relation to whatever work/matter comes before him. The system will not be able to remove him and can't touch him, because inspite of such a behaviour, he is discharging his duties.

I always kept wondering why the media and the general public was up and against the state government and the police for the arrest of the two girls for the post and 'like' on facebook, when we should be blaming the magistrate for this fiasco. I don't believe the magistrate is bound to accept anything or everything the police files for the case, or have I mixed up the Criminal Procedure Code.
