Saikrishna & Associates managing partner Saikrishna Rajagopal won an order from the Delhi high court, modifying its earlier trademark injunction against German auto maker Audi from using the “TT” trademark, which was also used by Delhi-based garment maker TT Textiles.

The Delhi high court today modified its order to exclude merchandise related to the Audi TT, TTRS and TTS ranges of cars from the ambit of the earlier injunction, though the injunction remains in effect over class 18 leather goods and clothing, according to a person with knowledge of the case.

Advocate Shilpa Jain of Sharma Advocates represented TT Textiles.

TT Textiles had filed a trademark infringement suit claiming damages for Rs 25 lakh against Audi for “selling car and the related accessories with the mark ‘TT’ clandestinely in Delhi”, with the court ordering an injunction against the auto maker earlier this month.

The court had ordered:

This Court is of the view that the plaintiffs have made out a prima facie case for an ex parte ad interim injunction and in case such an order is not passed at this stage, irreparable prejudice would be caused to them. The balance of convenience too lies in favour of the plaintiffs.

The next hearing on the substance of the ban in other categories will be argued in December.

Isn't Audi a client of that barucha partner who moved to CAM DELHI? They also refer briefs to a former CGST.

I think they just got permission to use TTRS in case of motor vehicles and not TT. Audi had registration for TTRS in class 12 and not TT. Saikrishna were not extremely forthcoming to the Court. The other advocate did very well in the end, Saikrishna not so much. I was there in Najimi Waziri's Court.
