Bail of Janhavi Gadkar, now jailed for 46 days, rejected for second time

The bail of Reliance Industries in-house counsel Janhavi Gadkar, who allegedly killed two while driving drunk, has been rejected by the Kurla metropolitan magistrate in Mumbai today, reported NDTV and others.

Her lawyer Mahesh Sabnis told the court that she would cooperate with the police and that blood and RTO reports have all been received by the police, while the surviving victims of the crash were all discharged from hospital, according to the Hindustan Times.

However the police argued that since the case was triable by a sessions court, a magistrate could not grant bail and that her bail was previously rejected by the same court because the offence was serious and the investigation continued.

Because there was tremendous criticism of the judicial system after Salman got bail in 15 minutes. ;-)

The SC has time and again said that bail should be given as of right. The issue with the Salman Khan trial is really not the fact that he got bail, but the fact that the investigation dragged on for as long as it did (I wonder why that happened), that witnesses have played hide and seek and that the protracted trial really made it easier for things to slip through the cracks (whether deliberately or negligently). Also, Salman Khan getting bail should be a precedent and not a deterrent for granting bail in this case. Is there a possibly of JG running away? If she's on the loose, would that be likely to lead to more crime or disturbance of peace or interfere with the investigation etc.? If she has the backing that people are reporting, then whether she is in jail pre-conviction or not, it won't make a lick of a difference to her eventual sentencing.

If the public is baying for her blood, then have a speedy trial and sentence her. Not granting her bail isn't really helping her or the judiciary or the investigation or the victims. It's only the media and the eye-for-eye page view and TRP rhetoric that this is helping.

Justice is not served by denying her bail. Justice will be served when she is fairly and speedily sentenced.
