The ruling of the District & Sessions Judge was not that Sharmila could not be rearrested. Neither did he make any comment on the legality of the previous 13 years cointinual judicial remand which he referred to as separate charges not involving double jeopardy. He dismissed the case because the prosecution had not offered any evidence beyond hearsay. The prosecution merely stated things like everybody knows she is on a fast unto death and has been for the past 13 years. To give the Judge credit he added at the end of his judgement that the Government of Manipur should take measures to protect Irom Sharmila and ensure that she doesn't die because everybody does know she is on a fast until or unless the AFSPA is removed from Manipur and as it is still in place she would have died if she had not been rearrested.
