if ur passport has not bene impounded , i see no reason why.

further, if u passport has been impounded, u may move an applicatyion before the Court for permission for return of passport and travel.

Pendency of CBI case is not an absolute bar to travel abroad. However, the person concerned need to take permission from the concerned trial court to go abroad. Incase, you are yet to apply for passport then you have to enclose NOC of the trial court with the applicaion form. Grant of permission by the court depends upon the gravity of offence, likelihood of escape to other country and such permission is absolutely at the discretion of the court. Incase , you are aggrieved by refusal then you may approach High Court.

If you are a government employee you will need NOC from the employer also for applying for new passport or renewal of passport apart from trial court NOC.The government may not grant NOC if Disciplinary proceedings are pending
