Joint Decree holders (D H R) filed E P against the tenant (J D R) to take a position of the property. Tenant set-up a third party and filed the objection petition (E A) restricting to take position of the property and got the stay against E P proceedings. Mean while one of the Decree holders (D H R) Expired. Legal heir of the D H R brought on record of the E P. But third party did not make a party to the E A since 5 years. Please tell anybody can legal heir of D H R can proceed in E P Get the position of the property because legal heir is a not a party to the E A .
