Iam the only son of my parents and married and have daughter 6 years old. In Kolkata two flats are in the name of my father. These two flats was obtained when our main house was handed over to the builders and my father’s share which was 50% of the property. He got these two flats and cash. My father had got this 50% share as a gift from his grand mother (father’s mother). The balance 50% went to my aunt. Now my father has gifted this entire property to my mother and my mother does not want to give anything to me. This gifting by my father was not informed to me. Now numerous times I am being asked to vacate and go. Initially Iam hearing that my mother is going to will one flat to her brother and the other flat she will dispose and sell off.

My question is that (a) Can my father gift the properties to mother without my consent ? (b) Can my mother give the one flat to her brother and sell off the other flat without my consent ? (c) If the flat is already sold can I reclaim? (d)Should I give an injuction on the property with the help of a lawyer?
