Employer Bond by taking a dated cheque.
Hello Everyone,
Please help me in below case.
One of the private software company took cheque of some amount for providing me the offer letter. Is this legal? I gave them a dated cheque of some amount and accepted the offer and signed the same. They provided the offer letter to me and they promised me at the time of joining after signing a 2 year legal contract they will return the cheque. But now i don’t want to join that company due to some reasons. But now they are forcing me to join, else they will encash the cheque.
Please suggest me what should i do in this case. Is the company have the rights to encash the cheque that they took from me for providing me just the offer letter not even joining letter.
If talk and request not work, can i go for filing a case against them.
Where and how to file a case for such scenarios

Why case and all?
Just go for stop cheque payment, write a letter to the company that you dont want to join.

Can i go for stop payment of cheque if i already have signed a contract for joining the company but still not joined. Do bank allow to stop payment in such a case ?

Can you please tell me the procedure to file a complaint or sending legal notice for such cases and where to file this type of complaints.
Bank doesn’t ask reason for stopping the cheques.
Further, as you have still not joined, nothing to be worried. Taking money for offering a job in itself a wrong doing/illegal.
So just relax and do the needful, as stated herein above rather than thinking of file a case. You motto shall be to be out of it rather going in it.

I also have same issue like I got offer letter from one company and I have given without date cheque in favor of that company. Now that company insisting me to join else telling me that they will deposit cheque. I don’t want to join that company And I already done stop payment from my end. So company can take legal action? In letter which I signed, only written that they are giving me offer letter against this cheque and this cheque will remain under possession for 12 months from date of joining but still I didn’t join and my joining date will after one month. So company can take legal action?
