Can I sell ancestral property on my name without consent.
My Grandfather died in 2013.
He made registered will for us. In which he mentioned that the current property which is 4 floors building with 8 rooms. He allotted 4 (A, B, C, D) of his sons 2 rooms each.
and mentioned if they want to reconstruct the building then 1 floor to each one when the contribute the cost of construction.
We also put up our names on property card as per the will.
My 2 rooms are under my possession.(I am C)
all my uncles are not ready to reconstruct the building.
But my one uncles (uncle B) is having 4 rooms possession, 2 of which he should give them back to 2 remaining uncles (uncle A, D). but he is not willing to do so. So my oldest uncle( Uncle A) filed case in court for the same. the case is currently going on. In that case the uncle B did not present for the first few dates and then suddenly came up with new will of my grandfather which states 5 rooms are allotted to him. all the rights in his wife’s name. in which we just had 1 room each. if we want to sell the single room also we need to give them preference.
I am nowhere involved in that case until now.
Now my question is my name is on the property card and i have my 2 rooms under my possession. So can i sell my rights given to me as per First will of my grandfather or my 2 rooms without any consent of my uncles as i am sole owner of those 2 rooms.
