Shardul Amarchand Mangaldas Mumbai-based lateral hire Abhishek Sinha, who was reportedly poached in April from Khaitan & Co where he was an associate partner, will return to Khaitan & Co as an associate partner, according to two authoritative sources.

We have reached out to Shardul Amarchand Mangaldas, Khaitan & Co and Sinha for comment earlier today but have not received a response.

Sinha graduated from ILS Pune in 2006, began his career at DSK Legal, then joined AZB & Partners, and joined Khaitan in 2009 where he also spent six months at Morrison & Foerster in Japan.

Nothing to do with targets. This is past history with an incoming high profile partner. Star he may be but ask the associates of his last firm and they will testify that he is a very difficult person to work with. Sam needs to factor this or there will be other departures soon

When I was considering law firms I got so many bad reviews abt Khaitan I dropped it from my list and never applied there... what surprises me is that I have never come across anyone who praises Khaitan in person and it is only on LI that there are these ridiculously made up happy comments abt KCO!

The difference is that in other firms partners are partners, the difference between salary and equity is just the manner of risk and compensation ... They all sign the partnership deed ... In KCO an associate partner is an associate .. With no deed and no other rights ...

People like Abhishek were early hires. Then came Akshay/Shuva etc. Obviously the younger partners like Abhishek are not in the same league as Akshay/Shuva. All the indiscriminate pre-Akshay hiring will obviously need to unwind eventually - I'm surprised the process has already started. This is a great sign from SAM - bring the food on the table or get going!!

My friend, this could have been true but not for Abhishek. Abhishek was made the HR Partner and CLE partner at SAM Mumbai. He was also sent couple of weeks back for the Alex Mundi conference. It can, though, be true for other hires at SAM mumbai.

I am an associate at Khaitan and really glad with this move. I am a firm believer that Khaitan has got its basic principles rights. With Abhishek re-joining (someone who was seen as hardworking and promising with great career within Khaitan), my belief is reinforced.

Looking back, Khaitan Mumbai didn't lose much. One Mr Khan who was just an year or so in India, and other Mr Roy who was 6 months into Khaitan when he left for SAM.

And that's the reason they have become the go to firm for big PE houses like Temasek,Providence, TPG,Barings, Apax, BX etc...and also for big corporates. They all suffer from quality issues.

SAM isn't a place to be in.KCO is a heaven, its a good decision and may trigger few more exits. KCO is a heaven as it gives more money, less work load, zero target, international opportunities, a good management team which has established best HR practice in last 5-6 years and centrally located work place at LP. What more do you need?

Best HR practice in 5-6 years. Seems you have no idea about KCO's HR. All those who were there between 2010-early 2015 have left. The decent one was absorbed by AZB. One got lucky and got a place at SAM (beats everyone how? may be to help them poach), one was freelancing till reliance took pity.

Did Abhishek have any tiff with SM or AC? Now that SM is the boss of everyone in Mumbai(other than AC and his team), everyone must follow his command to the T. Simple rule in all places - he who gets the bread sets the rules.. wonder whether other salaried partners are following SM and AC. Otherwise, similar fate (good or bad) will visit them! Amen.

You'd be surprised - I think commenters on LI often put too much stake in this 'loyalty' or 'staying in jobs for 10 years before moving' business.

Fact is, at the end of the day, most law firms are desperate for good partners, so if someone is a good, most law firms are happy to ignore where they've worked or for how long...

we have worked with Abhishek and he is not only a good lawyer, but have a great business sense. this makes him a great consultant, adviser and a friend.

BTW BMW did a press release when he bought his 5 series, and made a statement that - BMW has a fancy
lawyer as their customer.

Will Abhishek's departure have any impact on the Lex Mundi relationship? Who is managing the relationship now? Its anyway a personal relationship of Shardul but he may wish to instruct one of the salaried partners to handle the same. Also, SAM has many brilliant salaried partners in Mumbai so, hopefully, Abhishek's space can be filled up very easily and quickly.

Hilarious how so many 'Lawyers' will comment on all articles on LI on the basis of 'Rumours' and their personal feelings or try and disrespect someone in a way such that their comments do not get edited on LI, but none of these 'Lawyers' will even have the balls (for lack of a better word) to put up their real names while commenting here or comment on the Facebook page of LI.

Kian - You need to review the commenting anonymous policy. Perhaps create a login/password with the work ids of lawyers to comment, but then that would jeopardize the number of hits on your site? Either ways, lets get a grip on the anonymous gossip mongering may be?

Restricting comments only to those working in law firms is ridiculous and unworkable. As I've argued before, anonymity has some value in a profession where most seniors are so autocratic to allow no dissent.

As it is, it seems like there's a bit of gossipmongering here but we try to step in when it gets too personal or beyond what is commonly known, etc... And feel free to report a comment if we don't get the reference or something slips through.

Half the other comments, like rumouring chocolate fudge and bonus cheques are obviously just nonsense and speculation, so why would anyone take them seriously?

The level of bitchiness or nonsensical comments, I do not find on any other legal website. Is this something to do with some dark and inherent Indian trait -- like the so-called crab-in-the-basket syndrome.

Curiously, the same Indians who consider themselves so smart - are the first to fall for con acts like Nigerian lottery scam, dictator leaving a huge fortune, etc - as documented by an European agency (largest number of "hits" and people getting duped were from this country!!). Way to go, I say....

Abhishek is an excellent lawyer, which ever firm he goes, the clients who value his competency will go with him. The law firm doesn't matter, what matters is the value add which he does on each of his assignment.

He is an asset to any firm he works for KCO is lucky to get him back.

yes, we can talk about the same lack of balls on getting across any critique, including of any form of management (government, corporates, law firms, law schools, schools etc.) all across the country. How does putting a name out there justify the ability to criticise or critique? In fact, this completely emasculates the person critiquing and will ensure that nobody will criticize since there is a ready withchunt on. This is effectively telling every person who critiques a law firm to put out their name so that they can be gone after. May as well put Kian out of business while we are at it. I certainly don't see such requirements when everyone is happy to critique law firms and their management etc., so why with respect to individuals only

Perhaps the way to look at it is actually that the person who is being criticized to develop a pair or grow up (bricks and bones and all that cannot kill you) and if she thinks its serious enough, let the person come up and justify herself.

Kian- i completely disagree with your policies as you have ensured that gossip doesnt flow in a profession where nothing is ever disclosed publicly. Banter is also limited to random statements and this actually leads to a crimp on the information available (which is sometimes gossip, but otherwise info that is not readily available). Completely against the tenets of freedom of speech and expression and yes, I do know that there are limitations on it. Why not instead have some simple "blind item" rules like the magazines and the newspapers? No names, allow innuendos and move on. He doesn't have to say or explain anything to anyone. KCO has very friendly environment. The way KCO management have accepted him the others too will accept him.

He must have thought 1000 times before taking the decision to go back. And he known the people in KCO very well. So it won't be a problem to face them...!!

Khaitan is truly a friendly firm .. It even allows partners to change practice areas (from infrastructure to securities litigation no less) after 15 years in the professions .. Not possible to get any friendlier ..

My God, just saw the frenzy here. Vultures who have nothing to do but sing and eat dead meat.

Abhishek was part of the rubric and fabric of KCO, and yes, a lot of us were disappointed when he left. But as friends and family do, we wished him well for a good future and have mostly always stayed in touch with him.

We are glad he's coming back! Our gain and SAM's loss.

And unbenownst to several of you, we back our management. They've obviously taken a conscious decision to bring him on board; I just want to say to all of you

I think he can survive in SAM.. he worked for only a few months in Khaitan (i.e. he dosent really have the Khaitan background)and he has had some good law firm experience in US

He is a tremendous lawyer and super connected (true rainmaker). As any New York firm. Just matter of time before Iqbal will displace both AC as Managing Partner Mumbai Region, and SM as Head of M&A, with partners of US firms as his associates. Time will tell. KCO will bleed.

Ever wondered why and how KCO emerged from nowhere in 2007 - 2008 to one of the top 3/4 firms in the country, with no Bombay links? Do some research.
