Cops arrest gay man under section 377 for cheating on arranged wife

A Bangalore employee of Infosys has been arrested under section 377 of the Indian Penal Code for allegedly having sex with another man, which was recorded by his arranged-marriage-wife of six months on a hidden camera, reported the Bangalore Mirror.

The Supreme Court reinstated the colonial-era section 377 provision earlier this year after the Delhi high court had struck down the law, which bans “carnal intercourse against the order of nature” and has been used by police to harass the gay community.

Though I have utter respect for sexual preferences of people I feel that the wife deserves justice.

A man who being fully aware of his sexual preferences goes ahead and marries a girl concealing things and continues fooling her deserves to go around free. Yeah, possible, 2015 coming... Imagine the same thing to you when the girl who marries you, conceals, and still goes around. Life is too short to be lived. We dont marry every alternate day and such things are a scar that pest you throughout.

The problem here is arranged marriage, not homosexuality. The man wouldn't have been arrested if he was cheating with a woman. Section 377 needs to go, else there will be more such unfair arrests.

What if the woman with whom he was cheating with was a married woman? Would the man still not have been arrested? Also, could you please clarify what difference it would make whether the marriage was 'arranged' or not?
